NEW YORK (AP) — Yes, you’ll get a shot at an extra hour’s sleep. But even with that, it might be one of the most dreaded weekends on the American calendar: the end of daylight saving time.

Only 12% of U.S. adults favor the current system of daylight saving time, which has people in most states changing the clocks twice a year, according to a new AP-NORC poll, while 47% are opposed and 40% are neutral.

Around the country, the clocks will go back one hour at 2 a.m. Sunday (respective local times) to mark the return to standard time and more daylight in the mornings. The poll from&nbsp;<a href="https://apnorc.org/" target="_blank">The Associated Press-NORC Center for Public Affairs Research</a>&nbsp;shows that for many Americans, it’s an unwelcome change — and if forced to choose, most would prefer to keep that extra hour of daylight in the evening.

Pranava Jayanti is among those who strongly oppose the switch. The 31-year-old Los Angeles resident grew up in India, where the clocks don’t change. When he came to the United States for graduate school, some relatives made sure he knew about it.

He thought he was prepared, “but when it actually happened, it still took me by surprise,” Jayanti said, because of how quickly it got dark in the latter half of the day.

There have been calls for the U.S. to stop making the twice-yearly changes, including&nbsp;<a href="https://apnews.com/article/daylight-saving-time-clock-change-us-europe-77b497a3ce679463c4ab47a210fb16ee">a piece of legislation</a>&nbsp;that stalled after the Senate passed it in 2022. Among those urging that the country stick to one time for the entire year are the American Medical Association and American Academy of Sleep Medicine, as well as President Donald Trump,&nbsp;<a href="https://apnews.com/article/trump-daylight-saving-time-dd756bcf1f923c72b47d862c43be75d3">who issued a social media post</a>&nbsp;about it earlier this year.

Permanent daylight saving (not daylight savings, as many people say colloquially) would be unpopular with a significant chunk of people, though, the poll found — particularly those who prefer mornings.

The United States first started&nbsp;<a href="https://apnews.com/article/springing-forward-daylight-saving-time-c87a434fb84af044690ad0f48c80544e">using the time shift over a century ago</a>, during World War I, then again in World War II. Congress passed a law in 1966 that allowed states to decide if they would have it or not, but required their choices to be uniform across their territories. All states except Arizona and Hawaii make the time shifts; those two states remain on standard time year-round.

Time changes are also undertaken in some other parts of the world, like Canada and Europe, but not in others, like Asia. Europe and North America&nbsp;<a href="https://apnews.com/article/daylight-saving-time-clock-change-us-europe-77b497a3ce679463c4ab47a210fb16ee">change the clocks a week apart</a>, resulting in a short period where the time difference between the regions is an hour shorter than the rest of the year.

But although about half of U.S. adults are opposed to the switch — including 27% who are “strongly” opposed — many don’t care one way or another. That’s particularly true of adults under 30, with 51% saying they neither favor nor oppose the practice. Those over 30 are more likely to be opposed to it, with about half saying they dislike the twice-a-year switching of clocks.

If they had to choose one time for the country to use, more than half of adults — 56% - prefer making daylight saving time permanent, with less light in the morning and more light in the evening. About 4 in 10 prefer standard time, with more light in the morning and less in the evening.

Those who consider themselves “night people” are much more partial to permanent daylight saving time: 61% of them say this would be their choice.

“Morning people” were just about evenly split, with 49% of them preferring permanent daylight saving time, and 50% wanting permanent standard time.

Vicky Robson is one of those night people. If the 74-year-old retired nurse had to pick one time to go by, it would definitely be permanent daylight saving.

“I don’t get up early in the morning, so I don’t need the light in the mornings,” said Robson, of Albert Lea, Minnesota. “I need it more in the late afternoon, early evening. I like when it’s light later, because that’s when I do things. I’ve always worked the evening shift and now that I’m retired, I would go out and take a walk after supper if it was light.”

There’s no overwhelming evidence that daylight or standard time would be better for society, although&nbsp;<a href="https://apnews.com/article/daylight-saving-time-health-effects-body-b67f3f0c00774851514c7fc80913c7c4">there is advice for how to adjust</a>&nbsp;sleep and habits to deal with it.

New research from Stanford University has found that at least when it comes to humans and our internal clocks — our circadian rhythm — having a single time would be better for health than switching. It also found that standard time had slightly better health benefits than daylight saving time.

“The more light you have earlier in the morning, the more robust your clock is,” said Jamie Zeitzer, one of the study authors and co-director of the Center for Sleep and Circadian Sciences at Stanford.

But that’s only one aspect, he added. There are a range of others, from economics to people’s personal preferences.

“This is something that people feel very passionate about, and their passion is usually driven by ... themselves, what they would prefer,” he said. “There is no time policy that you can have that will make everyone happy.”

America did try once, in the mid-1970s, to switch to permanent daylight saving time. It was supposed to be a two-year experiment, but lasted less than a year because it was so unpopular.

At this point, the time shift and the resulting change in daylight hours in different seasons have become part of our culture, said Chad Orzel, professor of physics and astronomy at Union College and author of “A Brief History of Timekeeping.”

“People really like having the long evenings in the summer,” he said. But “we drop back in the fall so that we don’t have the thing that everybody hates, which is it being dark until after you get to work. ... We have earlyish sunrises in the winter and late sunsets in the summer. We like both of those things. The price we pay for that is we have to change the clocks twice a year.”

The AP-NORC poll of 1,289 adults was conducted Oct. 9-13, using a sample drawn from NORC’s probability-based AmeriSpeak Panel, which is designed to be representative of the U.S. population. The margin of sampling error for adults overall is plus or minus 3.8 percentage points.

Police ask for help to ID Kansas City burglary suspects

WASHINGTON (AP) —President Trump says he'll fund SNAP if the courts give more clarity.

On Friday evening, the president suggested on social media that the government would comply with&nbsp;<a href="https://apnews.com/article/snap-shutdown-lawsuits-deadline-4af8b0dec6cd31cddd023cc99c131b73">court rulings</a>&nbsp;to pay for food aid during the government shutdown but said more clarity is needed first.

“Even if we get immediate guidance, it will unfortunately be delayed while States get the money out,” Trump said. Federal funds for the program are expected to be frozen starting Saturday.

“If we are given the appropriate legal direction by the Court, it will BE MY HONOR to provide the funding.”

He sought to blame Democrats for the delay and urged SNAP recipients to call Minority Leader Chuck Schumer.

HARVEY COUNTY —The Harvey County Sheriff’s Office has received confirmation as to the identity of human remains found in southeastern Harvey County on Oct. 1, according to a media release.

The individual was identified as Robert F. Williams, 35, of Wichita.

Williams’ identity was confirmed through DNA testing with living relatives conducted by the Sedgwick County Regional Forensic Science Center. The Ninth District Coroner’s Office assisted in the investigation.

Human remains later attributed to Williams were discovered in a hay field by a farmer in the 3000 block of South Hillside Road on Oct. 1. Information identifying Williams was not found at the scene.

The farmstead is southeast of Newton. It is unknown why Williams was in the area where he was found. It is suspected he died in the summer. No foul play is suspected in Williams’ death. No further investigation is anticipated.

HARVEY COUNTY —The Harvey County Sheriff’s Office has begun an investigation after human remains were found southeast of Newton.

Emergency personnel were dispatched around noon to the 3000 block of South Hillside Road after a farmer discovered the remains in a hay field.

The cause of death nor the identity of the individual have been determined. The Harvey County Coroner’s Office is assisting in the investigation.

Sheriff confirms identity of body found in rural Kan. hay field

BOSTON (AP) — Two federal judges ruled nearly simultaneously on Friday that President Donald Trump’s administration must continue to pay for SNAP, the nation’s biggest food aid program, using emergency reserve funds during the government shutdown.

The judges in Massachusetts and Rhode Island gave the administration leeway on whether to fund the program partially or in full for November. That also brings uncertainty about how things will unfold and will delay payments for many beneficiaries whose cards would normally be recharged early in the month.

The U.S. Department of Agriculture planned to freeze payments to the Supplemental Nutrition Assistance Program starting Nov. 1 because it said it could no longer keep funding it due to the shutdown. The program serves about 1 in 8 Americans and is a major piece of the nation’s social safety net — and it costs about $8 billion per month nationally.

U.S. Sen. Amy Klobuchar, a Minnesota Democrat and the ranking member of the Senate Agriculture committee that oversees the food aid program, said Friday's rulings from judges nominated to the bench by former President Barack Obama confirm what Democrats have been saying: "The administration is choosing not to feed Americans in need, despite knowing that it is legally required to do so.”

Judges agree at least one fund must go toward SNAP

Democratic state attorneys general or governors from 25 states, as well as the District of Columbia, challenged the plan to pause the program, contending that the administration has a legal obligation to keep it running in their jurisdictions.

The administration said it wasn’t allowed to use a contingency fund of about $5 billion for the program, which reversed a USDA plan from before the shutdown that said money would be tapped to keep SNAP running. The Democratic officials argued that not only could that money be used, but that it must be. They also said a separate fund with around $23 billion is available for the cause.

In Providence, Rhode Island, U.S. District Judge John J. McConnell ruled from the bench in a case filed by cities and nonprofits that the program must be funded using at least the contingency funds, and he asked for an update on progress by Monday.

Along with ordering the federal government to use emergency reserves to backfill SNAP benefits, McConnell ruled that all previous work requirement waivers must continue to be honored. The USDA during the shutdown has terminated existing waivers that exempted work requirements for older adults, veterans and others.

There were similar elements in the Boston case, where U.S. District Judge Indira Talwani ruled in a written opinion that the USDA has to pay for SNAP, calling the suspension “unlawful.” She ordered the federal government to advise the court by Monday as to whether they will use the emergency reserve funds to provide reduced SNAP benefits for November or fully fund the program “using both contingency funds and additional available funds.

“Defendants’ suspension of SNAP payments was based on the erroneous conclusion that the Contingency Funds could not be used to ensure continuation of SNAP payments,” she wrote. “This court has now clarified that Defendants are required to use those Contingency Funds as necessary for the SNAP program.”

For many, benefits will still be delayed after the ruling

No matter how the rulings came down, the benefits for millions of people will be delayed in November because the process of loading cards can take a week or more in many states.

The administration did not immediately say whether it would appeal the rulings.

<a href="https://apnews.com/article/shutdown-snap-states-help-a5ab631a93a6d8087a4448117f026fb7">States, food banks and SNAP recipients</a>&nbsp;have been bracing for an abrupt shift in how low-income people can get groceries. Advocates and beneficiaries say halting the food aid would force people to choose between buying groceries and paying other bills.

The majority of states have announced more or expedited funding for food banks or novel ways to load at least some benefits onto the SNAP debit cards.

Across the U.S., advocates who had been sounding the alarm for weeks about the pending SNAP benefits cut off let out a small sigh of relief on Friday as the rulings came down, while acknowledging the win is temporary and possibly not complete.

"Thousands of nonprofit food banks, pantries and other organizations across the country can avoid the impossible burden that would have resulted if SNAP benefits had been halted,” said Diane Yentel, president and CEO of the National Council of Nonprofits, one of the plaintiffs in the Rhode Island case.

The possibility of reduced benefits also means uncertainty

Cynthia Kirkhart, CEO of Facing Hunger Food Bank in Huntington, West Virginia, said her organization and the pantries it serves in Kentucky, Ohio and West Virginia will keep their extra hours this weekend, knowing that the people whose benefits usually arrive at the start of the month won’t see them.

“What we know, unless the administration is magical, is nothing is going to happen tomorrow,” she said.

Kristle Johnson, a 32-year-old full-time nursing student and mother of three in Florida, is concerned about the possibility of reduced benefits.

Despite buying meat in bulk, careful meal planning and not buying junk food, she said, her $994 a month benefit doesn’t buy a full month’s groceries.

“Now I have to deal with someone who wants to get rid of everything I have to keep my family afloat until I can better myself,” Johnson said of Trump.

The ruling doesn't resolve partisan tussles

At a Washington news conference earlier Friday, Agriculture Secretary Brooke Rollins, whose department runs SNAP, said the contingency funds in question would not cover the cost of the program for long. Speaking at a press conference with House Speaker Mike Johnson at the Capitol, she blamed Democrats for conducting a “disgusting dereliction of duty” by refusing to end their Senate filibuster as they hold out for an extension of health care funds.

A push this week to continue SNAP funding during the shutdown&nbsp;<a href="https://apnews.com/article/snap-benefits-government-shutdown-democrats-0cb0858eca47c90e2379f823d360083b">failed in Congress</a>.

To qualify for SNAP in 2025, a family of four’s net income after certain expenses can’t exceed the federal poverty line, which is about $31,000 per year. Last year, SNAP provided assistance to 41 million people, nearly two-thirds of whom were families with children.

“The court’s ruling protects millions of families, seniors, and veterans from being used as leverage in a political fight and upholds the principle that no one in America should go hungry,” Skye Perryman, president and CEO of Democracy Forward, said of the Rhode Island decision.

McConnell ruled from the bench in a case filed by cities and nonprofits that the program must be funded using at least the contingency funds, and he asked for an update on progress by Monday.Along with ordering the federal government to use emergency reserves to backfill SNAP benefits, McConnell ruled that all previous work requirement waivers must continue to be honored. The USDA during the shutdown has terminated existing waivers that exempted work requirements for older adults, veterans and others.There were similar elements in the Boston case, where U.S. District Judge Indira Talwani ruled in a written opinion that the USDA has to pay for SNAP, calling the suspension “unlawful.” She ordered the federal government to advise the court by Monday as to whether they will use the emergency reserve funds to provide reduced SNAP benefits for November or fully fund the program “using both contingency funds and additional available funds.“Defendants’ suspension of SNAP payments was based on the erroneous conclusion that the Contingency Funds could not be used to ensure continuation of SNAP payments,” she wrote. “This court has now clarified that Defendants are required to use those Contingency Funds as necessary for the SNAP program.”<h2>For many, benefits will still be delayed after the ruling</h2>No matter how the rulings came down, the benefits for millions of people will be delayed in November because the process of loading cards can take a week or more in many states.The administration did not immediately say whether it would appeal the rulings.<a href="https://apnews.com/article/shutdown-snap-states-help-a5ab631a93a6d8087a4448117f026fb7">States, food banks and SNAP recipients</a>&nbsp;have been bracing for an abrupt shift in how low-income people can get groceries. It closed out a third straight winning week and a sixth straight winning month, its longest monthly winning streak since 2021.

The Dow Jones Industrial Average added 40 points, or 0.1%, and the Nasdaq composite gained 0.6%.

Amazon led the way and jumped 9.6%. The retail giant was by far the strongest force lifting the market after reporting profit for the latest quarter that blew past analysts’ expectations. CEO Andy Jassy said growth for its booming cloud-computing business has accelerated to a pace it hasn’t seen since 2022.

Amazon’s massive size of roughly $2.4 trillion means its stock movements carry more weight on the S&amp;P 500 than almost any other company’s. Without it, the S&amp;P 500 would have been down for the day.

Wall Street, led by Amazon, ends another winning week and month

TOPEKA — State and local leaders gathered Thursday at the new Robert B. Docking State Office Building to celebrate completion of the three-year, $120 million project.

It took more than a decade for the state to determine what to do with the Docking building, as historical preservationists fought to keep the original 14-story facility, built in 1954. In the end, the state Legislature approved demolition and construction of a new three-story building.

“The opening of the new Docking State Office Building represents what we can accomplish when we work together to reimagine something from the past to meet the needs of today and the future,” said Gov. Laura Kelly in a news release.&nbsp;

The new building reuses significant materials from the original Docking building, according to&nbsp;<a href="https://admin.ks.gov/offices/facilities-property-management/docking-state-office-building-reconstruction" target="_blank">a state website&nbsp;</a>that tracks construction progress. More than 50,000 square feet of limestone was reclaimed and reused, as were granite, greenstone and multiple historical features.&nbsp;

“One of the goals for the new Docking Building was to create one of the most efficient, modern, and beautiful buildings in the country, and for this facility to be a ‘front door’ to the state government for visitors to the capitol,” said Kansas Department of Administration Secretary Adam Proffitt in the&nbsp; release.&nbsp;

Last week, Kansas Department of Administration Deputy Secretary Frank Burnam received the Innovation in State Government Award from the National Association of State Chief Administrators for his work on the project, the news release said.

“With 98% of the materials of the old building incorporated into the body of the new building, Kansas has integrated continuity and environmental efficiency into the Docking State Office Building,” said Brian Docking, grandson of Gov. Robert Docking. “Today I represent my great grandparents, my grandparents, and my father and uncle and the future of our family to say we are humbled by this honor.”

The total cost of the project was just under $140 million, with $60 million appropriated from the state general fund and the remaining balance paid through American Rescue Plan Act dollars, said Steven Wu, senior fiscal analyst at the Kansas Legislative Research Department.

DEARBORN, Mich. (AP) — Multiple people who had been allegedly plotting a violent attack over the Halloween weekend were arrested Friday in Michigan, FBI Director&nbsp;<a href="https://apnews.com/hub/kash-patel">Kash Patel</a>&nbsp;said in a social media post.

Patel said more information would be released later. But the law enforcement effort appeared to be in the Detroit area.

FBI and state police vehicles were in a neighborhood near Fordson High School in Dearborn. People wearing shirts marked FBI walked in and out of a house, including one person who collected paper bags and other items from an evidence truck.

Dearborn police said in a social media post that it was aware that the FBI was conducting operations in the city and assured residents that there was no threat to the community. A message seeking comment from an FBI spokesperson in Detroit was not immediately returned.

Separately, in May, the FBI said it arrested a man who had spent months&nbsp;<a href="https://apnews.com/article/michigan-army-site-attack-plan-f51b1f3c8c9219e87d6d6df2c3c2d11d">planning an attack</a>&nbsp;against a U.S. Army site in suburban Detroit on behalf of the Islamic State group. The man, Ammar Said, didn’t know that his supposed allies in the alleged plot were undercover FBI employees.

Said remains in custody, charged with attempting to provide support to a terrorist organization. The criminal complaint was replaced in September with a criminal “information” document, signaling that a guilty plea is likely.

According to Saline County Sheriff, Roger Soldan a 2000 Saturn Vue driven by an 18-year-old woman was doing donuts in the parking lot of Kenwood Hall,&nbsp;900 Greeley Avenue in Salina. The driver lost control of the SUV. It struck a dumpster and continued into the south wall of Kenwood Hall.

There were bathrooms in the area of where the crash happened which caused a flood in the building.

EMS transported a 17-year old female passenger to Salina Regional Health Center for a wrist injury. The 18-year old driver was cited for Reckless Driving. The sheriff's office released no additional details.

KANSAS CITY—Law enforcement investigating another homicide in Kansas City have identified the victim as 44-year-old&nbsp;Terrell Bullock, according to KCPD&nbsp;Captain Jake Becchina.

Just before 12:30p.m. Wednesday, police were dispatched to a shooting at a residence in the 3000 block of Bellefontaine in Kansas City, Missouri, according to Becchina.

Officers were led inside the residence where they located Bullock unresponsive. Officers called for EMS who responded to the scene and transported him to the hospital where he was pronounced deceased.

Preliminary information indicates the shooting appears to have taken place inside or near the front of the residence there. There is no known suspect information at this time, according to Becchina.&nbsp;

WASHINGTON (AP) — President Donald Trump is calling on the Senate to scrap the filibuster, so that the Republican majority can bypass Democrats and reopen the federal government.

“THE CHOICE IS CLEAR — INITIATE THE ‘NUCLEAR OPTION,’ GET RID OF THE FILIBUSTER,” Trump posted Thursday night on his social media site, Truth Social.

The filibuster is a long-standing tactic in the Senate to delay or block votes on legislation by keeping the debate running. It requires 60 votes in a full Senate to overcome a filibuster, giving Democrats a check on the 53-seat Republican majority that led to the start of the Oct. 1 shutdown when the new fiscal year began.

Trump's call to terminate the filibuster could alter the ways the Senate and congressional dealmaking operate, with the president saying in his post that he gave a “great deal” of thought to the choice on his flight back from Asia on Thursday.

Trump spent the past week with foreign leaders in Malaysia, Japan and South Korea, finishing his tour by meeting with Chinese leader Xi Jinping.

The president declared the trip a success because of a trade truce with China and foreign investment planned for American industries, but he said one question kept coming up during his time there about why did “powerful Republicans allow” the Democrats to shut down parts of the government.

In fact, Trump’s&nbsp;<a href="https://apnews.com/article/what-is-republican-trump-tax-bill-f65be44e1050431a601320197322551b">“big, beautiful bill”</a>&nbsp;signed into law this summer, delivered the most substantial cut ever to the&nbsp;<a href="https://apnews.com/article/food-stamps-snap-states-trump-2c604216d26a9edf84fe502136be6d6f">Supplemental Nutrition Assistance Program</a>, known as SNAP, projected to result in some 2.4 million people off the program.

At the same time, many Americans who purchase their own health insurance through the federal and state marketplaces, with open enrollment also beginning Saturday, are experiencing sticker shock as premium prices jump.

“We are holding food over the heads of poor people so that we can take away their health care,” said Rev. Ryan Stoess, during a prayer with religious leaders at the U.S. Capitol.

“God help us,” he said, “when the cruelty is the point.”

The House remains closed down under Johnson for the past month. Senators are preparing to depart Thursday for the long weekend. Trump returns late Thursday after a whirlwind tour of Asia.

That means the shutdown, in its 30th day, appears all but certain to stretch into another week, putting it on track to become the&nbsp;<a href="https://apnews.com/article/30769167ab7a4ef9adf880d020b775dd">longest in history</a>, surpassing the 35-day lapse that ended in 2019, during Trump’s first term over his demands to build the U.S.-Mexico border wall.

Many expect that once those winners and losers are declared, and the Democrats and Republicans assess their political standing with the voters, they might be ready to hunker down for a deal.

“I hope that it frees people up to move forward with opening the government,” said Senate Majority Leader John Thune, R-S.D.

The Republicans, who have majority control of Congress, find themselves in an unusual position, defending the furloughed federal workers and shuttered programs they have long sought to cut — including most recently with nearly $1 trillion in reductions in Trump’s big tax breaks and spending bill.

Medicaid, the health care program, and SNAP food aid, suffered sizable blows this summer, in part by imposing new work requirements. For SNAP recipients, many of whom were already required to work, the new requirements extend to older Americans up to age 64 and parents of older school-age children.

House Democratic Leader Hakeem Jeffries said Republicans now “have the nerve” to suggest it’s a political strategy to withhold food aid.

“We are trying to lift up the quality of life for the American people,” Jeffries of New York said about his party.

“The American people understand that there’s a Republican health care crisis,” he said. “The American people understand Republicans enacted the largest cut to nutritional assistance in American history when they cut $186 billion from their one, big, ugly bill.”

During the summer debate over Trump’s big bill, Johnson and other Republicans railed against what they characterized as lazy Americans, riding what the House speaker calls the “gravy train” of government benefits.

The speaker spoke about able-bodied young men playing video games while receiving Medicaid health care benefits and insisted the new work requirements for the aid programs would weed out what they called “waste, fraud and abuse.”

“What we’re talking about, again, is able-bodied workers, many of whom are refusing to work because they’re gaming the system,” Johnson said in spring on CBS’ “Face the Nation.”

“And when we make them work, it’ll be better for everybody, a win-win-win for all,” he said.

What remains out of reach, for now, is any relief from the new health care prices,&nbsp;<a href="https://apnews.com/article/health-care-subsidies-congress-shutdown-democrats-republicans-bb3464820a347fd2c0399e78e335881e">posted this week</a>, that are expected to put insurance out of reach for many Americans when federal subsidies that help offset those costs are set to expire at the end of the year.

Democrats have been holding out for negotiations with Trump and the Republicans to keep those subsidies in place. Republicans say they can address the issue later, once the government reopens.

Spiraling effects of the shutdown leave lawmakers grasping for ways to end it

A third teenager has been arrested and charged with the killing of a congressional intern in the nation’s capital, a crime that President Donald Trump cited when he announced a&nbsp;<a href="https://apnews.com/article/trump-washington-increased-federal-law-enforcement-takeover-33b186a95dabf111bac61db398aa7543">law enforcement surge</a>&nbsp;in Washington.

Naqwan Antonio Lucas, 18, has been indicted with first-degree murder and 15 other charges for the killing of Eric Tarpinian-Jachym of Granby, Massachusetts who worked in the office of Kansas 4th District Congressman Ron Estes. Lucas pleaded not guilty on Thursday.

Tarpinian-Jachym, 21, died a day after he was struck by stray bullets near Washington’s Mount Vernon Square the night of June 30.

Authorities last month arrested&nbsp;<a href="https://apnews.com/article/eric-tarpinian-jachym-intern-killed-arrests-pirro-2ab7b67305d6f12de6b6e456699c5a8e">two 17-year-old suspects</a>&nbsp;in the shooting, Kelvin Thomas Jr. and Jailen Lucas. They were charged as adults for first-degree murder while armed.

Prosecutors said Naqwan Lucas and Jailen Lucas are brothers.

U.S. Attorney Jeanine Pirro said last month that Tarpinian-Jachym was an “innocent bystander” who wasn’t an intended target of the gunfire.

Pirro’s office said he was hit when three armed suspects left a stolen vehicle and began firing shots at two young men. Tarpinian-Jachym was shot four times. Five other people also were assaulted or injured.

Naqwan Lucas faces a second indictment for allegedly killing 17-year-old Zoey Kelly on July 4. Kelly was found dead of a gunshot wound to the head inside a storage container wrapped in bedding in a bedroom closet, prosecutors said.

Naqwan Lucas also pleaded not guilty to these charges. His attorney, Steven Kiersh, did not immediately return a phone message seeking comment.

Surveillance video helped investigators identify the three suspects, police said.

Trump mentioned Tarpinian-Jachym’s killing — but not his name — during an Aug. 11 news conference where he announced a federal intervention for a “public safety emergency” in the District of Columbia.

The University of Massachusetts Amherst student was in Washington to work as a summer intern in the office of Rep. Ron Estes, R-Kansas.

BUTLER COUNTY—Law enforcement are investigating an alleged drive-by shooting in Butler County.

Just after 6:30p.m. Wednesday, police were dispatched to a home in the 600 Block of Santa Fe in Augusta, according to a media release from the Augusta Department of Public Safety. 

A women who lives there found her home and vehicle had ben shot at numerous times overnight. The initial investigation uncovered circumstances leading officers to believe the shooting occurred between 1 and 2a.m. Damage was limited to one home and vehicle. It was an isolated incident and there were no injuries reported.

Six people who died at a Colorado dairy farm this summer were exposed to hydrogen sulfide gas, authorities said Thursday.

The Weld County coroner's office drew its conclusions from autopsies and toxicology tests.

The&nbsp;<a href="https://apnews.com/article/colorado-dairy-deaths-8ee96fdcb698f4d5de1a231a5389d22a">deaths of five men and a teenager</a>&nbsp;on Aug. 20 sent&nbsp;<a href="https://apnews.com/article/dairy-farm-colorado-deaths-gas-exposure-a058110957fc63af087e984d4de676d2">shockwaves through the rural communities</a>&nbsp;in and around Keenesburg, 35 miles (55 kilometers) northeast of Denver, where emergency responders entered a confined space to recover the bodies. Authorities had immediately expressed concern that the deaths were linked to harmful gases.

The coroner's findings will factor into an investigation by federal workplace safety and health investigators into determining what happened at the industrial-scale dairy, owned by California-based Prospect Ranch, as well as the role of a dairy equipment contractor.

Authorities had immediately expressed concern that the deaths were linked to harmful gases.The coroner's findings will factor into an investigation by federal workplace safety and health investigators into determining what happened at the industrial-scale dairy, owned by California-based Prospect Ranch, as well as the role of a dairy equipment contractor.The autopsy reports gave no indication of the circumstances of the deaths, describing only an industrial accident in a confined space at a dairy farm.<h2>What happened at the dairy farm</h2>Dairy operators and federal workplace safety authorities have said little about what went wrong.The hazards of confined spaces on farms and dairies are a well-known and persistent cause of death in agriculture across the U.S. — often from exposure to odorless and colorless noxious gases, or due to asphyxiation in closed spaces where oxygen has been depleted.All those who died in Colorado were Latino, ranging in age from 17 to 50. Four of them, including the teenage high school student, were from the same extended family.As the news spread of the deaths, people in the community organized fundraisers including a dance, haircuts and a car wash to benefit the families of those who died. Several local churches organized a memorial gathering at the local fair grounds in Keenesburg in early September that included singing “Amazing Grace."“People are in shock. Everybody in the ranching and dairy community knows it’s difficult, hard work and there are accidents,” said the Rev. Thomas Kuffel, a priest at Catholic churches including Holy Family in Keenesburg. “But this is very foreign to them, in that accidents are typically one or two people.”<h2>Who are the people that died</h2>First responders from a rural fire district in Weld County were dispatched around 6 p.m. on Aug. 20 to Prospect Ranch and took their own safety precautions as they entered a confined space.Alejandro Espinoza Cruz, of Nunn, was found dead along with his 17-year-old son Oscar Espinoza Leos and a second son, 29-year-old Carlos Espinoza Prado of Evans.The Espinozas are related by marriage to a 36-year-old from Greeley who died — Jorge Sanchez Pena, according to Jolene Weiner, chief deputy county coroner for Weld County.The other two men — Ricardo Gomez Galvan, 40, and Noe Montañez Casañas, 32 — lived in Keenesburg. The remains of Montañez Casañas, a veterinarian who was employed under a U.S. visa, were repatriated to the central Mexican state of Hidalgo, according to the Mexican consulate in Denver. Relatives of those who died couldn't immediately be reached.<h2>Why confined spaces are dangerous</h2>Silos that store grain and feed are among the most deadly confined spaces on farms, with hazards that include gases from fodder for feeding cattle that ferments and releases carbon dioxide and nitrogen oxide, according to William Field, a professor at Purdue University who compiles annual reports on injuries and fatalities.The next most deadly group of hazards are associated with the handling and storage of animal manure, which also include dangers from harmful gases. As manure decomposes, it releases toxic gases that can replace available oxygen with carbon dioxide, methane, ammonia and hydrogen sulfide.Hydrogen sulfide is a highly toxic gas that is colorless but has a sulfurous smell reminiscent of rotten eggs.After some exposure, people can quickly lose the ability to smell the gas even though it’s still there through “olfactory fatigue.” At high concentrations, the ability to smell the gas can be lost instantly, according to the Occupational Safety and Health Administration.Proven safety precautions include access to a self-contained breathing apparatus with a short supply of oxygen and emergency response planning and training, Field said.“Having an emergency action plan that would eliminate the cascading effects, so that if somebody is down, somebody doesn’t just jump in there,” is important, he said.<h2>What workplace oversight was there</h2>OSHA can take six months or longer to complete an investigation into workplace fatalities and typically focuses on identifying root causes.OSHA has launched inspections and investigations of Prospect Ranch as well as Johnstown, Colorado-based Fiske Electric, whose subsidiary High Plains Robotics services dairy equipment and employed some of those who died. Prospect Ranch could not be immediately reached for comment, and Fiske Electric did not respond to email and phone messages.The progress of the investigations is unclear. Local, regional and Washington, D.C.-based representatives for OSHA did not immediately respond to phone calls and emails on Thursday. Automated responses said no one could reply because of the&nbsp;<a href="https://apnews.com/article/government-shutdown-effects-trump-update-democrats-95b986b83b9802fe7a8374572fcd86f0">federal government shutdown</a>.It’s unclear if Espinoza Leos, the teenager, was assigned specifically to hazardous work, though that wouldn’t be unusual or prohibited by law. Federal regulations&nbsp;<a href="https://webapps.dol.gov/elaws/whd/flsa/docs/hazag.asp">allow</a>&nbsp;those who are 16 and older to do hazardous jobs in agriculture, while the minimum age is 18 in other industries, under child labor provisions of the Fair Labor Standards Act.Renée Anthony, an environmental engineer and director of the Great Plains Center for Agricultural Health at the University of Iowa, said federal regulations leave out detailed standards for confined space safety in the agriculture sector even where permits are required.Still, Anthony said all industry sectors, including agriculture, have an obligation under federal law to keep workplaces free from recognized hazards that can cause death or serious injury.
