ByHeart, a manufacturer of organic baby formula, recalled all of its products sold nationwide Tuesday, days after&nbsp;<a href="https://apnews.com/article/infant-botulism-formula-byheart-recall-fda-cdc-91019e385a98a2fceb26a12005ea3fbb">some batches</a>&nbsp;were recalled in an expanding outbreak of infant botulism.

All of the infants were hospitalized after consuming ByHeart formula, officials said. No deaths have been reported.

ByHeart officials expanded the voluntary recall from two lots announced Saturday to all products in consumers' homes and in stores. That includes ByHeart Whole Nutrition Infant Formula and Anywhere Pack pouches of powdered formula. The company sells about 200,000 cans of infant formula a month online and in stores such as Target, Walmart, Albertsons and Whole Foods, according to Dr. Devon Kuehn, chief medical officer.

Parents and caregivers who have the formula in their homes “should immediately discontinue use and dispose of the product,” Kuehn said.

Company officials said they enacted the unusual recall “in close collaboration” with the U.S. Food and Drug Administration “despite the fact that no unopened ByHeart product has tested positive” for the contamination.

California health officials earlier confirmed that a sample from an open can of ByHeart baby formula fed to an infant who got sick contained the type of bacteria that causes the toxin linked to the outbreak.

“This action underscores ByHeart’s core mission: protecting babies above all else,” the company said in a statement.

The U.S. Food and Drug Administration is investigating 84 cases of infant botulism detected since August. Of those, 36 consumed infant formula, with a more than a third who received ByHeart formula, the agency said in a statement.

“This information shows that ByHeart brand formula is disproportionately represented among sick infants in this outbreak, especially given that ByHeart represents an estimated 1% of all infant formula sales in the United States,” the FDA statement said.

ByHeart produces formula powder at a plant in Allerton, Iowa, and then ships it to a site in Portland, Oregon, for canning and distribution, Kuehn said. U.S. Food and Drug Administration inspectors were at the Portland plant Monday, she added.

In addition to the broad recall, the company said it is testing every batch of formula with an independent third-party laboratory, providing health officials full access to its sites and sharing results with regulators as they become available.

Infant botulism is a rare and serious illness that occurs in babies under age 1, whose gut microbiomes are immature. It is caused when the infants consume bacteria that contain spores that produce a toxin in the gut. Symptoms include constipation, poor feeding, drooping eyelid, weak muscle tone, difficulty swallowing and breathing problems, among others.

Babies who develop those symptoms need immediate medical attention. The sole treatment for the infection is BabyBIG, an IV medication made from blood plasma of people immunized against botulism.

ByHeart baby formula recall expanded as Infant botulism outbreak grows

WASHINGTON —President Trump observed Veterans Day at Arlington National Cemetery.&nbsp;It is the first Veterans Day since he returned to office.

Trump and Vice President JD Vance both wore gloves and overcoats against the cold in Washington, and the president also had a red scarf.

Trump stepped forward and laid a wreath at the Tomb of the Unknown Soldier, then reached out and touched the wreath before taps was played.

He, Vance and other top administration officials saluted throughout the music.

🎥President Trump observes Veterans Day at Arlington National Cemetery

KANSAS CITY —A second person injured in a crash that occurred October 29, in Kansas City, Missouri has died.

Just before 12:30p.m. on that Wednesday, a silver Dodge Journey was southbound on Broadway in Kansas City, Missouri, according to KCPD Captain Jake Becchina. The driver of the Dodge suffered a possible medical emergency and accelerated through the intersection of Linwood and Broadway. 

The vehicle traveled off the roadway to the right, struck an unoccupied parked Lexus and traveled up onto the sidewalk. The Dodge then struck a steel light pole, the Vietnam Memorial and continued traveling southbound through the grass and struck the side of the VFW building.

EMS transported both the driver and front seat passenger of the of the Dodge to a local hospital with life-threatening injuries. Both were reported in very critical condition.

The passenger of the Dodge Journey, an adult female,  was pronounced deceased on the night of October 29, according to Becchina.&nbsp;&nbsp;

On Monday, the Jackson County Medical Examiner’s Office reported the involved driver had succumbed to the injuries sustained in the crash and the driver was pronounced deceased by St. Lukes Hospital staff.

 Police released no additional details including the name of the victim. This is fatality #57 compared to #80 last year in Kansas City, Missouri.

DOUGLAS COUNTY—Law enforcement are investigating a suspect on multiple allegations after a search in Lawrence.

During the noon hour on Monday,&nbsp; police&nbsp; were attempting to find a man who witnesses say threatened a couple with a firearm, then took off, according to a social media report from the Lawrence Police Department.

Officers were dispatched to 23rd and Louisiana just before noon and got a description of the suspect and additional evidence.

About an hour after the initial call, the suspect was spotted near 23rd and Naismith Drive. When officers attempted to approach him, he ran into a nearby grocery store. 

 Officers set up a perimeter, while others entered the business and located the suspect. Officers safely arrested him, took him to the hospital to get checked out because he was complaining of stomach issues, and then to the Douglas County Correctional Facility. 

There were no injuries reported during the entire incident.

Police did not release the name of the suspect or possible charges.

Police capture wanted Kansas suspect inside grocery store

WASHINGTON (AP) — The senators — eight in total — faced almost instant blowback from Democrats as&nbsp;<a href="https://apnews.com/article/government-shutdown-congress-trump-641e7e2324f261da72395b604d9540e8">they broke ranks and voted</a>&nbsp;to allow the Senate to move forward on&nbsp;<a href="https://apnews.com/article/government-shutdown-senate-deal-schumer-trump-33c6e37c68e9bf2d33770de0f3399563">compromise legislation</a>&nbsp;that would reopen the government.

Their decision Sunday night was labeled a “betrayal” and “pathetic” by some of the most prominent voices in the Democratic Party.

“To my mind, this was a very, very bad vote,” said Sen. Bernie Sanders, a Vermont independent who caucuses with Democrats.

The group of defectors consisted of several senators who are retiring next year, as well as a number of former governors. Republican House Speaker Mike Johnson of Louisiana praised them Monday morning, saying they “decided to put principle over their personal politics.”

The senators surely knew the criticism that was coming. But after huddling for hours — often in the Senate basement — over the last week, each senator reached the same conclusion: It was time for&nbsp;<a href="https://apnews.com/hub/government-shutdown">the government shutdown</a>&nbsp;to end.

Fetterman, who was elected in 2022, has also been voting to reopen the government, breaking with his party as he does on many other issues. He has criticized Democrats for using the shutdown to demand concessions on health care.

“I’m sorry to our military, SNAP recipients, gov workers, and Capitol Police who haven’t been paid in weeks,” he said on social media. “It should’ve never come to this. This was a failure.”

Shaheen, a senior Democrat who will be retiring from the Senate, often took the lead in negotiating&nbsp;<a href="https://apnews.com/article/government-shutdown-senate-deal-schumer-trump-33c6e37c68e9bf2d33770de0f3399563">the compromise legislation</a>&nbsp;to end the shutdown. She had made it a priority to extend subsidies for&nbsp;<a href="https://apnews.com/article/health-care-subsidies-congress-shutdown-democrats-republicans-bb3464820a347fd2c0399e78e335881e">health plans offered under the Affordable Care Act</a>, but she had also expressed reservations about voting to shut down the government.

In the end, she settled for a pledge from Senate Majority Leader John Thune of South Dakota to hold a vote in December on the health subsidies.

“This was the only deal on the table. It was our best chance to reopen the government and immediately begin negotiations to extend the ACA tax credits that tens of millions of Americans rely on to keep costs down,” she said at a news conference following the Sunday night vote.

Durbin is another senator who will be retiring after a long Senate career. Durbin holds the No. 2 position in Democratic leadership and broke ranks with Senate Democratic Leader Chuck Schumer of New York after saying that the shutdown had caused too much pain for the American people.

In a statement before the vote, Durbin, who argued that Republicans are still to blame for the shutdown, said, “This bill is not perfect, but it takes important steps to reduce their shutdown’s hurt. Not only would it fully fund SNAP for the year ahead, but it would reverse the mass firings the Trump Administration ordered throughout the shutdown.”

Kaine, a former Virginia governor, was one of the last Democrats to join the group willing to vote to advance to the bill. He said that, as late as Sunday evening, he was checking over the legislation with his staff. If the deal is finalized, it’s not clear how quickly SNAP benefits might start flowing.

Still, the Trump administration said in a filing Monday with the Supreme Court that it shouldn’t be up to the courts. “The answer to this crisis is not for federal courts to reallocate resources without lawful authority,” Solicitor General D. John Sauer said in the papers. “The only way to end this crisis — which the Executive is adamant to end — is for Congress to reopen the government.”

The cascading legal rulings — plus the varying responses of each state to the shutoff — means people who rely on SNAP are in vastly different situations.

Some have all their benefits, some have none. In states including North Carolina and Texas, beneficiaries have received partial amounts.

In Pennsylvania, full benefits went out to some people on Friday. But Jim Malliard, 41, of Franklin, said he had not received anything by Monday.

Malliard is a full-time caretaker for his wife, who is blind and had a series of strokes earlier this year, and his teenage daughter, who suffered severe medical complications from surgery last year.

That stress has only been compounded by the pause in the $350 a month he receives in SNAP for himself, his wife and daughter. He has yet to receive any SNAP payment for November, and he’s down to $10 in his account and is relying on what’s left in the pantry — mostly rice and ramen.

“It’s kind of been a lot of late nights, making sure I had everything down to the penny to make sure I was right,” Malliard said. “To say anxiety has been my issue for the past two weeks is putting it mildly.”

WABAUNSEE COUNTY— Two people died in an accident just before 11:30a.m. Monday in Wabaunsee County.

The Kansas Highway Patrol reported a 2004 Jeep Liberty driven by Cheryl A. Martin, 63, Junction City,&nbsp;was eastbound on Interstate 70 at McFarland.&nbsp;&nbsp;The Jeep drifted into the median, struck a culvert and rolled. A 2007 Peterbilt semi driven by Robert Arnold, 53, Hays was entering the Interstate from an entrance ramp and struck the Jeep.

Martin and a passenger Perry A. Martin, 65, Junction City, were prononced dead at the scene and were transported Forensic Medical. Arnold was not injured.&nbsp; Perry Martin was not wearing a seat belt, according to the KHP.

Kansas couple killed in Jeep, semi crash on Interstate 70

CASS COUNTY—Five people were injured in a fire on Sunday night in the Kansas City suburb of Belton&nbsp;

Crews responded to a house fire in the area of 187th and Y Highway, acording to a media release from the Belton Fire Department

The residence suffered significant damage throughout. EMS transported&nbsp; 4 people to Belton Regional and 1 person to Research Medical Center due to injuries from the fire.

Three others were treated at the scene for minor injuries. The fire is considered accidental and was caused by improperly charged/stored lithium-ion batteries.

5 hospitalized after lithium-ion battery fire at KC area home

WASHINGTON (AP) — The Senate passed legislation Monday to reopen the government, bringing the&nbsp;<a href="https://apnews.com/hub/government-shutdown">longest shutdown in history</a>&nbsp;closer to an end as a&nbsp;<a href="https://apnews.com/article/government-shutdown-8-democrats-e83180c0b69642a00a234c244d9ea76e">small group of Democrats</a>&nbsp;ratified a deal with Republicans despite searing criticism from within their party.

The 41-day shutdown could last a few more days as members of the House, which has been on recess since mid-September, return to Washington to vote on&nbsp;<a href="https://apnews.com/article/government-shutdown-senate-deal-schumer-trump-33c6e37c68e9bf2d33770de0f3399563">the legislation</a>. President Donald Trump has signaled support for the bill, saying Monday that “we’re going to be opening up our country very quickly.”

The final Senate vote, 60-40, broke a grueling stalemate that lasted more than six weeks as Democrats demanded that Republicans negotiate with them to extend health care tax credits that expire Jan. 1. The Republicans never did, and five moderate Democrats eventually switched their votes as federal food aid was delayed, airport delays worsened and hundreds of thousands of federal workers continued to go unpaid.&nbsp;Kansas U.S. Senators Jerry Moran and Roger Marshall voted with the majority.

After the vote, Senate Majority leader John Thune, R-S.D., thanked unpaid staff and Capitol Police who stood near him on the floor. He said he realized the strain had been immense for “six excruciating weeks.”

“I am very, very happy to be able to say we are coming to the end,” Thune said.

House Speaker Mike Johnson urged lawmakers to start returning to Washington “right now" given shutdown-related travel delays. “We have to do this as quickly as possible," said Johnson, who has kept the House out of session since mid-September, when the House passed a bill to continue government funding.

After weeks of negotiations, A group of three former governors — New Hampshire Sen. Jeanne Shaheen, New Hampshire Sen. Maggie Hassan and Independent Sen. Angus King of Maine — agreed to vote to advance three bipartisan annual spending bills and extend the rest of government funding until late January. Republicans promised to hold a vote to extend the health care subsidies by mid-December, but there was no guarantee of success.

Shaheen said Monday that “this was the option on the table” after Republicans had refused to budge.

“We had reached a point where I think a number of us believed that the shutdown had been very effective in raising the concern about health care," she said, and the promise for a future vote “gives us an opportunity to continue to address that going forward."

The legislation includes a reversal of the mass firings of federal workers by the Trump administration since the shutdown began on Oct. 1. It also protects federal workers against further layoffs through January and guarantees they are paid once the shutdown is over.

In addition to Shaheen, King and Hassan, Democratic Sen. Tim Kaine of Virginia, home to tens of thousands of federal workers, also voted Sunday in favor of moving forward on the agreement. Illinois Sen. Dick Durbin, the No. 2 Democrat, Pennsylvania Sen. John Fetterman and Nevada Sens. Catherine Cortez Masto and Jacky Rosen also voted yes. All other Democrats, including Senate Democratic leader Chuck Schumer of New York, voted against it.

The moderates had expected a larger number of Democrats to vote with them as 10 to 12 Democratic senators had been part of the negotiations. But in the end, only five switched their votes — the exact number that Republicans needed. King, Cortez Masto and Fetterman had already been voting to open the government since Oct. 1.

Many Democrats call the vote a “mistake”

Schumer, who received blowback from his party in March when he voted to keep the government open, said he could not “in good faith” support it after meeting with his caucus for more than two hours on Sunday.

“We will not give up the fight,” Schumer said, adding that Democrats have now “sounded the alarm” on health care.

Connecticut Sen. Chris Murphy said “we could have won" and giving up will only embolden Trump. He said voters were on their side after&nbsp;<a href="https://apnews.com/article/election-2025-results-takeaways-charts-e440e2b57f751acb5e173ab35aab1bc6">overwhelming wins for Democrats in last week’s elections</a>.

“We were building momentum to help save our democracy,” Murphy said.

Independent Sen. Bernie Sanders of Vermont said that striking a deal was “a horrific mistake.”

Others gave Schumer a nod of support. House Democratic leader Hakeem Jeffries had criticized Schumer in March after his vote to keep the government open. But he praised the Senate Democratic leader on Monday and expressed support for his leadership throughout the shutdown.

“The American people know we are on the right side of this fight,” Jeffries said Monday, pointing to Tuesday's election results.

It’s unclear whether the two parties would be able to find any common ground on the health care subsidies before a promised December vote in the Senate. House Speaker Mike Johnson, R-La., has said he will not commit to bringing it up in his chamber.

On Monday, Johnson said House Republicans have always been open to voting to reform what he called the “unaffordable care act” but again did not say if they would vote on the subsidies.

Some Republicans have said they are open to extending the COVID-19-era tax credits as premiums could skyrocket for millions of people, but they also want new limits on who can receive the subsidies. Some argue that the tax dollars for the plans should be routed through individuals.

Senate Appropriations Committee Chairwoman Susan Collins said Monday that she's supportive of extending the tax credits with changes, like new income caps. Some Democrats have signaled they could be open to that idea.

“We do need to act by the end of the year, and that is exactly what the majority leader has promised,” Collins said.

Other Republicans, including Trump, have used the debate to renew their yearslong criticism of the law and called for it to be scrapped or overhauled.

In a possible preview, the Senate voted 47-53 along party lines Monday not to extend the subsidies for a year. Majority Republicans allowed the vote as part of a separate deal with Democrats to speed up votes and send the legislation to the House.

FINNEY COUNTY—Law enforcement are investigating a suspect for alleged violent sex crimes.

On November 8, police responded to the north part of Garden City regarding a rape that just occurred, according to a media release from Garden City Police. After arriving, they spoke with a woman who reported being assaulted by a man she knew, identified as 29-year-old Sami Ullah.

The investigation revealed that Ullah arrived at the woman’s home while she was in the backyard. He allegedly grabbed and forced her into the garage, where he pushed her to the ground and sexually assaulted her. 

Ullah fled the scene but was located shortly afterward by Officers and taken into custody. He is&nbsp;in the Finney County Jail on requested charges of Rape, Aggravated Kidnapping, and Stalking.&nbsp;

A 31-year old man told police a woman broke a window and entered his home.&nbsp; The woman allegedly struck the man with a broom, causing some injuries.

Officers arrested 28-year-old Shealynn Klinkerman and booked her into the Saline County Jail on requested charges of: Battery, Criminal Damage to Property and Interference with Law Enforcement.

The victim did not need any medical treatment for his injuries.

Police: Woman attacked Kansas man with a broom

WASHINGTON (AP) — Hormone-based drugs used to treat hot flashes and other menopause symptoms will no longer carry a bold warning label about stroke, heart attack, dementia and other serious risks, the&nbsp;<a href="https://apnews.com/hub/us-food-and-drug-administration">Food and Drug Administration</a>&nbsp;announced Monday.

U.S. health officials said they will remove the boxed warning from more than 20 pills, patches and creams containing hormones like estrogen and progestin, which are approved to ease disruptive symptoms like night sweats.

The change has been supported by some doctors — including&nbsp;<a href="https://apnews.com/article/fda-trump-makary-vaccines-ultraprocessed-food-safety-ce9df8eb4bba5c950e500c62d975afe2">FDA Commissioner Marty Makary</a>, who has called the current label outdated and unnecessary.

Health officials explained the move by pointing to studies suggesting&nbsp;<a href="https://apnews.com/article/hormone-therapy-estrogen-hot-flashes-fda-5b1f29a73553c142f67b1f88b6656428">hormone therapy</a>&nbsp;has few risks when started before age 60 or within 10 years of menopause symptoms.

“We’re challenging outdated thinking and recommitting to evidence-based medicine that empowers rather than restricts,”&nbsp;<a href="https://apnews.com/hub/robert-f-kennedy-jr">Health Secretary Robert F. Kennedy Jr.</a>&nbsp;said in introducing the update.

The 22-year-old FDA warning advised doctors that hormone therapy can increase the risk of blood clots, heart problems and other health issues, citing data published more than 20 years ago.

Many doctors — and pharmaceutical companies — have called for removing or revising the label, which they say discourages prescriptions and scares off women who could benefit.

Dr. Steven Fleischman, president of the American College of Obstetricians and Gynecologists, said the warnings have created a lot of hesitancy among patients.

“I can spend 30 minutes counseling someone about hormone-replacement therapy— tell them everything — but when they fill the prescription and see that warning they just get scared,” Fleischman said.

Other experts have opposed making changes to the label without a&nbsp;<a href="https://apnews.com/article/fda-kennedy-antidepressants-hormones-meetings-experts-afbd525b29ca5e2585b79548a075be75">careful, transparent process</a>.

Medical guidelines generally recommend the drugs for a limited duration in younger women going through menopause who don’t have complicating risks, such as breast cancer. FDA’s updated prescribing information mostly matches that approach.

But Makary and some other doctors have suggested that hormone therapy’s benefits can go far beyond managing uncomfortable mid-life symptoms. Before becoming FDA commissioner, Makary dedicated a chapter of his most recent book to extolling the overall benefits of hormone therapy and criticizing doctors unwilling to prescribe it.

On Monday he reiterated that viewpoint, citing figures suggesting hormone-therapy reduces heart disease, Alzheimer’s and other age-related conditions.

“With few exceptions, there may be no other medication in the modern era that can improve the health outcomes of women at a population level more than hormone replacement therapy,” Makary told reporters.

The veracity of those benefits remains the subject of ongoing research and debate— including among experts whose work led to the original warning.

Continuing analysis has shown a more nuanced picture of the risks.

A new analysis of the 2002 data published in September found that women in their 50s taking estrogen-based drugs faced no increased risk of heart problems, whereas women in their 70s did. The data was unclear for women in their 60s, and the authors advised caution.

Additionally, many newer forms of the drugs have been introduced since the early 2000s, including vaginal creams and tablets that deliver lower hormone doses than pills, patches and other drugs that circulate throughout the bloodstream.

The original language contained in the boxed warning will still be available to prescribers, but it will appear lower down on the label. The label will retain a boxed warning that women who have not had a hysterectomy should receive a combination of estrogen-progestin due to risks of cancer in the lining of the uterus.

Hanging over Monday’s announcement was the way the agency laid the groundwork for the decision.

Rather than convening a standing advisory committees on women’s health or drug safety, Makary earlier this year invited a dozen doctors and researchers who overwhelmingly supported the health benefits of hormone-replacement drugs.

Many of the panelists invited to the July meeting consult for drugmakers or prescribe the medications in their private practices. Two of the experts also spoke at Monday’s FDA news conference.

Nearly 80 researchers later sent a letter to the FDA calling for an official advisory committee meeting.

DOUGLAS COUNTY —Law enforcement investigating a fatal hit-and-run that killed a KU student have made an arrest.

After an extensive investigation, which included examining evidence and responding to numerous tips from the public, on Sunday, the Douglas County Sheriff’s Office deputies located the suspected vehicle and driver, identified as 36-year-old William Klinger, involved in Thursday’s hit-and-run crash outside of Lawrence.&nbsp;

The crash killed 20-year-old University of Kansas student Elsa McGrain, according to sheriff's department spokesman Officer&nbsp;George Diepenbrock.

Elsa was struck and killed while running in the 1700 block of E 1500 Road, on November 6.&nbsp; After striking Elsa, the suspected driver left the scene.&nbsp;

Deputies later found her early Friday morning. A passerby spotted her on the side of the road around 3:35 a.m., according to Diepenbrock.

According to the sheriff's department Klingler was arrested around 5:45 p.m. on Sunday. He is being held on requested charges of reckless involuntary homicide. He has a previous conviction for Tampering with Electronic Monitoring Equipment: Knowingly and without authorization removing or disabling in the case of a Felony, according to the Kansas Department of Corrections.&nbsp;

McGrain, a native of Omaha, Nebraska, was a pre-med student at KU.
