State of the State speech sets tone of governor’s spending, policy effort

TOPEKA — Gov. Laura Kelly’s seventh State of the State speech on Wednesday called for investments in water resources and public schools, streamlining early childhood regulation, pursuit of sustainable tax policy and expansion of Medicaid eligibility.

Kelly, a Democrat who took office in 2019 as the state’s 48th governor after serving 14 years as a state senator, urged the Kansas Legislature to frame these significant issues in the context of what Kansas could look like at the end of this century.

She asked lawmakers to step outside the day-to-day competition to score short-term political points. She recommended elected officials at the Capitol devote more energy to shaping what would lie ahead for Kansas’ children and grandchildren.

“Since I’ve been in office, we have built an incredibly strong foundation for our state. Kansas has never been in better financial shape,” Kelly said. “Now, it’s time to build on that foundation.”

While looking down the road to 2100, she posed big questions: Is the agriculture economy booming because water resources were preserved and rural Kansas didn’t dry up? Do Kansas businesses have the best and brightest workers because the priority was superior public schools? Is Kansas an economic-development powerhouse? Did Kansas hold onto its small-town traditions?

“It’s easy to forget that we aren’t playing some kind of game here,” Kelly said. “We have real power. The decisions we make in this building touch every aspect of the lives of the people we work for. Here’s the truth. The Kansas our grandkids will inherit is up to us right now.”

Kelly said the mission was to filter through some pretty wacky notions to settle on smart, reasonable common-sense bipartisan ideas.

“I’m not asking you not to love your political party,” the Democratic governor said. “I’m just asking you to love your state a little more.”

Kelly said the way Kansas chose to invest in children would hold sway over the trajectory of the rest of this century. A child’s experiences from birth to age 5 played a central role in social and emotional development, academic achievement and career success, she said.

She said the state recognized the shortage of child-care providers and that skyrocketing costs handicapped businesses. Urgent state investment meant Kansas would added more child-care capacity in the next two years than in the previous 15 years, the governor said.

The problem? Kansas has siloed early-childhood services into four different state agencies.

“If a family is searching for care for a newborn, that family must navigate among three different agencies to figure out which program is the right fit,” Kelly said. “If a child care center wants to get off the ground, it must work with one state agency to get licensed, another to receive financial aid and workforce support, and a third to get assistance with start-up costs.”

Kelly’s solution: Create the Office of Early Childhood. It would be a one-stop shop for young families. This idea of eliminating irritating red tape and bureaucracy gained traction in the Kansas House in 2024, passing the chamber with 110 votes.

Meanwhile, Kelly proposed creation of the Office of Natural Resources to streamline management of water resources. Currently, those programs were shared among 14 different state agencies. This consolidation would improve the state’s ability to align policy, planning and investment, she said.

“When I imagine the end of this century and the state our youngest Kansans will inherit, I see so many good things on the horizon,” Kelly said. “But, there is one thing that is seriously concerning. Our dwindling water supply. Forget making it 75 years down the road. Some parts of western Kansas don’t have the groundwater to last another 25 years.”

Last year, the Legislature appropriated $35 million additional dollars in each of the next five years to improve the state’s ability to deliver a clean, sustainable water supply, stabilize the Ogallala Aquifer and maximize the capacity of reservoirs in Kansas.

Kelly’s budget recommendations, to be presented to House and Senate members Thursday, would add $30 million to the state’s annual investment in the water supply. That would raise the level of state investment to $90 million annually.

Kelly said the state required a solid K-12 public school system to continue to attract new businesses and young families in the future. Ninety-percent of the state’s students attend public schools, she said, and those districts represented the most effective place to invest in the next generations, the governor said.

“When we talk about protecting the Kansas way of life, our public schools are the heart and soul of so many of our communities,” Kelly said. “For both, the future we aspire to create and the values we aspire to maintain, we must continue to make our public schools our top priority.”

Kelly said she would “never, ever” take taxpayer dollars from public schools and give it to private schools. Kansas Republican legislative leaders have been preparing another bid to expand support for private or parochial education.

“Doing so weakens our public school system, particularly in our rural communities,” the governor said. “As a state, we just can’t afford to do that. Simply put, I will continue to reject any attempt, no matter what it looks like, to reroute public taxpayer dollars to public schools.”

She also said her 2025 state budget plan included funding to provide free school lunches to more than 35,000 Kansas students.

Kelly, who defeated Republican Kris Kobach in 2018 and the GOP’s Derek Schmidt in 2022, campaigned in both races against the reckless 2012 income tax reductions signed into law by Republican Gov. Sam Brownback. His goal was to end the state’s income tax. The resulting steep decline in state revenue wasn’t balanced with equivalent spending cuts, leading to years of budget problems that cut into appropriations for schools, highways and other core services.

In her six years as governor, Kelly said she’d signed into law more than $2 billion in tax cuts. In June, she signed into law a bill that cut state taxes by $1.2 billion over three years.

She said she wouldn’t support a proposal to slash the state corporate income tax to zero. The referred to the idea as a “non-starter.” The GOP leadership in the Senate and House also indicated they would attempt during the 2025 session to lower property tax burdens.

“We must stay on the path to prosperity as we move through the rest of the 21st century,” she said.

She preferred to postpone discussions about new tax reductions until the 2026 legislative session to get a better handle on the full fiscal impact of tax cuts adopted last year. However, she said she would consider changes to the state’s tax structure that paid for themselves and didn’t threaten the state’s long-term financial health.

Kelly did renew her push for the Legislature to expand eligibility for Medicaid to about 150,000 lower-income workers in the state. The proposal has been blocked by Republican lawmakers for more than a decade, and the governor said the only remaining objections centered on partisan politics.

“Over the past six years,” she said, “all the horror myths around Medicaid expansion have been debunked, and all the surrounding states have expanded.”

She said the lingering argument in Kansas was that it would be too expensive for the state to broaden access to Medicaid health services. In 2025, she said, it would cost the state $78.3 million to follow in the footsteps of dozens of other states. Instead of making that investment, the state has already left $7.6 billion in federal funding on the table in Washington, D.C., that could have flowed into the state’s medical system.

“If we can strip away partisan politics and just look at the numbers, we will expand Medicaid this year,” Kelly said.

Gov. Laura Kelly vows to focus on lasting future of Kansans, not quick political gains

An infectious disease expert says the relatively mild cases of avian influenza detected so far among dairy workers don’t warrant making a vaccine available to them, even as they work to contain and prevent spread of the contagious virus among herds.

Dr. Shira Doron, an epidemiologist and chief infection control officer for Tufts Medicine in Boston, said the minor spread of the H5N1 among humans – and no reported instances of human-to-human transmission – makes any widespread administration of a vaccine premature right now.

“There are also many logistical issues that would be associated with deployment of vaccine to farm workers – language barrier, undocumented status, compliance – so that is not the plan at this time, “ Doron said Friday morning during an Infectious Diseases Society of America teleconference.

H5N1 has circulated globally for decades, she said. Analysis of the strains currently circulating shows them to be poorly suited for transmission between humans and with low pandemic potential, according to Doron.

Human patients have also responded well to antiviral treatments such as Tamiflu, the doctor said.

The current avian flu strains have led to two severe cases in humans. One involved a 65-year-old person from Louisiana who contracted the virus from exposure to a combination of a non-commercial backyard flock and wild birds, state health officials said. It was&nbsp;<a href="https://lailluminator.com/2025/01/06/avian-flu-louisiana/" target="_blank">the nation’s first ever fatal human case</a>&nbsp;of avian flu, though the patient was reported to have underlying conditions that worsened after they contracted H5N1.

The other severe case was a teen in Canada who had to be admitted to a hospital’s intensive care unit. That patient contracted the virus from wild birds, Doron said.

Dr. Julio Figeroua, LSU Health chief of infectious diseases and a professor at Louisiana State University’s medical school in New Orleans, also took part in the IDSA teleconference. There have been no secondary avian flu cases related to the patient in Louisiana who died, he said.

“We have people who do hunting, hunting of geese and ducks, and so advisories have been put out to those for proper handling of those particular animals,” Figeroua said. “A lot of backyard flocks that are here and in urban and suburban areas are potentially also potential sources for transmission.”

In addition to 919 dairy herds in 16 states, the highly pathogenic H5N1 strain of bird flu has impacted more than 133 million poultry farms in all 50 states as of Wednesday, according to the U.S. Centers for Disease Control and Prevention.

Coordination about the various federal and state agencies responding to avian flu outbreaks will be crucial to containing its spread, especially as the incoming Trump administration takes over, Doron and Figueroa said.

Asked to provide an estimate for when the current H5N1 outbreak might be contained or peter out on its own, Doron said it’s difficult to determine at this point.

“I think it really is going to depend on how long immunity lasts, and it’s too early in the outbreak to know that,” she said. “… If the immunity doesn’t last more than a few months, then we could have ongoing spread indefinitely.”

No need to provide an avian flu vaccine for humans yet, expert says

Washington, D.C.&nbsp;- U.S. Senator&nbsp;Roger&nbsp;Marshall, a member of the Senate Health, Education, Labor, and Pensions (HELP) Committee, recently announced the creation of the Congressional Make America Healthy Again (MAHA) Caucus, according to a statement from the Senator's office.

This new caucus will focus on nutrition, access to affordable, high-quality-nutrient-dense foods, improving primary care, and addressing the root causes of chronic diseases.&nbsp;

Robert F. Kennedy Jr., President Trump’s nominee for Department of Health &amp; Human Services (HHS) Secretary, has endorsed the creation of this new caucus that will work to build a stronger and healthier America. Senator&nbsp;Marshall, a physician who practiced medicine for over 25 years,&nbsp;met with Mr. Kennedy&nbsp;earlier this week to discuss his nomination to lead HHS. Senator&nbsp;Marshall&nbsp;endorsed Mr. Kennedy’s candidacy following the meeting.&nbsp;&nbsp;

WASHINGTON —United States Capitol Police officers prevented a man from bringing a machete and three knives past a screening checkpoint in the Capitol Visitor Center.

Just after 2:00 p.m. Wednesday, during security screening at the CVC’s north doors, USCP officers spotted a machete in a bag, which was going through the x-ray machine. Officers stopped the machine and searched the bag, which contained a machete and three knives.&nbsp;

“Our officers know they cannot let their guard down for one second,” said U.S. Capitol Police Chief J. Thomas Manger. “It is this constant focus and attention to detail that helps keep this campus safe.”

44-year-old Mel J. Horne, of Washington, D.C., was arrested for multiple counts of Carrying a Dangerous Weapon.&nbsp;

Security screening was temporarily stopped at the north side of the Capitol Visitor Center, while the USCP investigated, but the checkpoint was reopened approximately an hour later. Public viewing for the lying in state was not stopped and will continue throughout the night, into Thursday morning.&nbsp;

Horne will be interviewed by USCP investigators to determine his motive. At this time there is no on-going threat towards the Congress, the U.S. Capitol, or the public.

Three knives were also found in the bag, along with the machete. Security screening was temporarily stopped at the north side of the Capitol Visitor Center while police investigated.

Police: Man with Machete Attempted to Enter U.S. Capitol 

Despite voicing opposition to abortion, most members of the Rolla City Council worried the ordinance would do little besides inspire costly litigation

Less than a month after a state constitutional amendment legalizing abortion went into effect, a national movement to establish pockets of resistance is dividing one Missouri town.

Rolla, a town of about 20,000 people that sits 100 miles southwest of St. Louis, is being courted by<a href="https://sanctuarycitiesfortheunborn.org/" target="_blank">&nbsp;Sanctuary Cities for the Unborn</a>, an anti-abortion activist group out of Texas. If approved by the city council, it would be the first municipality in Missouri to adopt the title.&nbsp;

But during a public hearing Monday night, council members expressed concerns about adopting the ordinance, which uses a 150-year-old federal law to give local citizens the ability to sue any person or entity who provides abortion medication. The concern is it would do little besides put the town at the center of costly litigation and negative national press.

“Why are we doing this?” Rolla Mayor Louis Magdits IV asked during&nbsp;<a href="https://www.youtube.com/watch?v=X33Di5KfsRU" target="_blank">Monday’s meeting.&nbsp;</a>“What is out to be accomplished?”

Rolla is home to one of Missouri’s six remaining Planned Parenthood clinics. The rest are located in and around Democrat-leaning cities Columbia, Kansas City and St. Louis.&nbsp;

<a href="https://www.warrencountyrecord.com/stories/wright-city-official-wont-back-local-push-to-ban-abortion,72627" target="_blank">Wright City,&nbsp;</a>a town of about 5,000 people just off Interstate 70, west of St. Louis, also considered becoming a sanctuary city for the unborn in 2023 but never made it official.&nbsp;

Missouri’s legal landscape around abortion has changed drastically since then.&nbsp;

Amendment 3, which was&nbsp;<a href="https://missouriindependent.com/2024/11/05/missouri-voters-overturn-states-near-total-abortion-ban/">narrowly approved by voters in November,</a>&nbsp;made unconstitutional the state’s trigger law, which in June 2022 outlawed all abortions in the state, with exceptions only for medical emergencies.&nbsp;

Under Amendment 3, Missourians have a constitutional right to reproductive health care, including abortion up until the point of fetal viability.&nbsp;

Abortions have not yet re-started in Missouri, though. Planned Parenthood is currently suing the state in an effort to take down its existing laws regulating abortion that they say make it impossible for clinics to offer the procedure.

As the fight over Amendment 3 plays out in court, anti-abortion advocates hope to wage a separate campaign at the local level. And Rolla was their first stop.&nbsp;

Rolla City Councilman Joshua Vroman, who filed the “sanctuary city” ordinance, said it&nbsp;doesn’t question the validity of Amendment 3, but rather makes note of an 1873 federal law on the books that bans mailing obscene material, including for the use of abortion.&nbsp;

He worked on the latest draft of the ordinance with Brian Westbrook, with St. Louis-based Coalition Life, and Mark Lee Dickson, founder of Sanctuary Cities for the Unborn.

<a href="https://uscode.house.gov/view.xhtml?req=granuleid:USC-prelim-title18-section1461&amp;num=0&amp;edition=prelim" target="_blank">The Comstock Act&nbsp;</a>outlaws the mailing of “obscene or crime-inciting” materials, including&nbsp;“every article or thing designed, adapted, or intended for producing abortion, or for any indecent or immoral use.”

A number of Missouri elected officials,<a href="https://missouriindependent.com/2024/11/06/missouri-abortion-access-planned-parenthood-lawsuit-amendment-3/">&nbsp;including U.S. Sen. Josh Hawley</a>&nbsp;and&nbsp;<a href="https://x.com/MarkMaxwellTV/status/1853542335172546707" target="_blank">Missouri Attorney General Andrew Bailey,</a>&nbsp;have called on President Joe Biden to enforce the Comstock Act in regards to medication abortion. The Biden administration has refused.&nbsp;

A renewed push for enforcement is expected when Donald Trump takes office again later this month. Trump’s prior administration did not enforce the law.

“We’re pointing to the Comstock Act saying ‘here’s the law, you have to work within the confines of this law, and here is the enforcement mechanism,’” Vroman said.&nbsp;

Magdits asked who would enforce the Rolla ordinance.&nbsp;

“The citizens will enforce,”&nbsp;Vroman said, drawing several outbursts of laughter from the crowd followed by a call for decorum.

Dickson, in an interview with The Independent, said law enforcement could not apply the ordinance, nor could a woman who receives and takes the medication be found liable under this ordinance.&nbsp;

It would rely solely on citizens suing any person or organization who provides abortion medication.&nbsp;

For example, he said, if an organization mailed abortion medication to a Rolla teenager, her parents could then sue the entity that mailed the medication.&nbsp;

And if Planned Parenthood again began prescribing drugs for medication abortions, an individual could sue Planned Parenthood.&nbsp;

The FDA has approved two medications —&nbsp;<a href="https://www.fda.gov/drugs/postmarket-drug-safety-information-patients-and-providers/information-about-mifepristone-medical-termination-pregnancy-through-ten-weeks-gestation" target="_blank">mifepristone and misoprostol&nbsp;</a>— for use in the first 10 weeks or pregnancy. The availability of both are under threat under the Comstock Act. Abortions performed after 10 weeks are done surgically.&nbsp;

In the six months after the Dobbs decision, the number of&nbsp;<a href="https://missouriindependent.com/2024/03/25/more-than-26000-self-managed-abortions-may-have-occurred-post-dobbs-study-shows/">self-managed medication abortions rose by more than 26,000</a>&nbsp;across the U.S. according to a&nbsp;<a href="https://jamanetwork.com/journals/jama/fullarticle/10.1001/jama.2024.4266?utm_campaign=articlePDF%26utm_medium=articlePDFlink%26utm_source=articlePDF%26utm_content=jama.2024.4266" target="_blank">study</a>&nbsp;published in JAMA, the American Medical Association’s journal. The medication is mailed everywhere in the U.S., including Missouri.

Vroman&nbsp;said the ordinance would only apply to elective abortions, not medically-necessary abortions.&nbsp;&nbsp;

The ACLU of Missouri disagrees, saying in a written statement that the ordinance would also leave hospitals and providers vulnerable to lawsuits, including when treating miscarriages, which are medically documented as abortions and are often treated using mifepristone or misoprostol, both of which can be used to induce labor or stop hemorrhaging after childbirth.&nbsp;

At one point during Monday night’s meeting, council members called upon Dr. Jenny Pennycook, an OB-GYN in Rolla, to explain her interpretation of the ordinance. She said she was trained at a Catholic Jesuit institution and has never been an abortion provider.&nbsp;

Asked by council members if she believed the ordinance could create hurdles for miscarriage care, Pennycook said yes.

Prior to the U.S. Supreme Court decision that overturned the constitutional right to an abortion in June 2022, Pennycook said she never had issues prescribing mifepristone or misoprostol.

Since then, Pennycook said she’s had numerous patients turned away from pharmacies, leaving her needing to call to clear up that the medication was not for abortion so her patient could access it.

“When pharmacists are scared about the Comstock Act and enforcement and whether or not they can dispense these medications, it makes it harder for patients to get these medications,” she said. “Untreated missed miscarriages can result in hemorrhage or infection and women can lose their uterus and never get pregnant again or even die.”

In a town that touts itself as “the middle of everywhere,” residents are wary of what could turn their&nbsp;<a href="https://www.rollacity.org/info/cd/comp2024-Rolla%20Initial%20Economic%20Indicators.pdf" target="_blank">recent economic and population growth</a>&nbsp;against them.&nbsp;

“We did not simply pick Rolla out of a hat,” Westbrook told the council after multiple members accused him and Dickson of targeting the town. “We were invited, specifically for the things that you guys are discussing today.”

Councilman Matt Fridley said while he opposes abortion, he doesn’t think it’s the responsibility of Rolla to resolve a state issue.&nbsp;

“I understand from a philosophical or a moral compass where you’re coming from for this, but I don’t believe the city should fight for this,” he said. “ … It creates negative press. It creates problems where individuals may go, ‘I don’t want to live in this community.’”&nbsp;

A few hours earlier, the council received a letter from the ACLU of Missouri that Magdits said he interpreted to mean: “this is a shot across the bow, and we’re watching what you’re doing.”

The letter, signed by Tori Schafer, an attorney who helped steer Amendment 3 to victory, threatened “costly litigation.”&nbsp;

“Rejecting this ordinance would demonstrate the city’s commitment to upholding the law and prioritizing the health and wellbeing of its community,” Schafer wrote. “Attempting to impose such a measure would invite expensive legal challenges, divert valuable city resources, and, most importantly, cause unnecessary harm and delay to individuals in need of critical health care.”&nbsp;

<a href="https://www.washingtonpost.com/politics/2023/09/01/texas-abortion-highways/" target="_blank">Some Texas towns have also expressed concerns over litigation costs</a>&nbsp;when considering similar ordinances. In Rolla, Dickson proposed a workaround: a pro-bono attorney.

Dickson said former solicitor general of Texas Jonathan Mitchel has agreed to represent the city of Rolla pro-bono if they are sued. But that’s only if the city agreed, and it would not cover the cost of additional legal representation.

Much of the council’s confusion also centered around who could bring a lawsuit and where it would be litigated.&nbsp;

Nathan Nickolaus, the city attorney, said he believes the ordinance would allow a citizen to sue anyone who they believe helped get abortion medication to a person in Rolla.

“We’re saying you can’t do this in a state that says you can do this in a country that says you can’t do this,” Nickolaus said.

&nbsp;That suit would likely end up in municipal court, he said, “which is woefully inadequate a place to hear this kind of case. No offense to anyone in the city — I used to be a municipal prosecutor — municipal court is kind of the McDonalds of the judicial system. It’s light kind of stuff.”&nbsp;

Magdits on multiple occasions said the issue wasn’t whether or not the council opposes abortion. It was about legal repercussions.

When he was called to the podium for public comments at the end of the meeting, Dickson said the issue at hand absolutely was abortion.

“This really is a pro-life issue,” he said. “ … Are we going to stand with the attorney general of Missouri, or are we going to stand with the ACLU?”

Magdits asked if the ordinance specified what kind of medication use would be subject to litigation.&nbsp;

“It’s about abortion-causing drugs that cause abortion,” Westbrook said.

“That’s a slick answer,” Magdits said, before concluding: “Go fight this somewhere else.”

Dickson has spent much of the past few years of his life driving across the south pitching Sanctuary Cities for the Unborn to receptive audiences. But on Monday, as he ventured a bit further north, he received an icy response.&nbsp;

It took him more than an hour to scrape the ice off his car. Then, he was greeted by a barrage of Rolla citizens who addressed him as a “carpetbagger.”&nbsp;

Despite an ice and winter storm passing through the town less than 24 hours earlier, the meeting happened as planned. Some residents during public comments took note of the small crowd, blaming the council for holding the meeting on the same day the public school district called off classes.

<a href="https://www.weareplannedparenthoodaction.org/a/pack-rolla-city-council" target="_blank">Planned Parenthood Great Rivers Action</a>&nbsp;called on citizens to show up wearing pink to protest the ordinance.&nbsp;

“These bills intimidate abortion seekers and their loved ones, and waste taxpayers’ time and money just to score political points,” the release said.

Rolla resident Britt Giger said she was used to the council’s “embarrassing, crazy, chaotic” meetings, but said Monday’s events could cause national embarrassment.&nbsp;

“I don’t want to scroll TikTok and see this meeting,” she said, adding: “Imagine how university growth could be impacted if women don’t want to come here anymore.”

She was followed by&nbsp;Jenny Cunningham&nbsp;who held her husband’s hand as she explained that they moved to Rolla about a year ago in the hopes of starting a family. When Amendment 3 passed, they breathed a sigh of relief. But news of this ordinance puts women back in the “crosshairs,” she said.

“This is a bounty hunter law,”&nbsp;Cunningham&nbsp;said. “This turns citizen against citizen during the most terrible and tragic times that people can face in their lives.”&nbsp;

Joe Dalton, founder and CEO of&nbsp;<a href="https://www.facebook.com/prcrolla" target="_blank">Pregnancy Resource Center of Rolla</a>, testified in support of the ordinance, emphasizing that Rolla citizens have access to abortion medication by mail despite the local Planned Parenthood currently being unable to prescribe it.&nbsp;

He was followed by a registered nurse who works in Rolla in a labor and delivery unit who also supported the ordinance.&nbsp;

“This would save the lives of countless children,” she implored the council.

Pamela Timson, a resident of Rolla for more than 40 years, urged the council to set the ordinance aside for good, sharing her own story of a medical condition that made childbirth dangerous.

She found it outrageous that Rolla would attempt to qualify a constitutional amendment so soon out of the gates.&nbsp;

“We haven’t even given our state government a chance to qualify it yet,” she said.

The council ultimately decided not to officially put the ordinance on the agenda for its next meeting. But Vroman still has the opportunity to bring his revised ordinance before the council during council comments later this month.

Vroman brought the initial ordinance forward in November before recruiting Westbrook and Dickson to help him write a revised draft.&nbsp;

At a Dec. 16 council meeting, Dominic Barceleau of the Missouri Attorney General’s office testified that state law does not prohibit Rolla from enacting such an ordinance.

“It’s the intent of the legislature to regulate abortion to the fullest extent of the law,” Barceleau said. “The attorney general’s position is that doesn’t prevent concurrent municipal regulation that’s also consistent with the legislature’s intent to regulate abortion.”

Dickson, who also drove up from Texas for that meeting, told council members the target of the ordinance was not just Planned Parenthood, but also pharmacies.&nbsp;

“So when cities do this, it really is doing as much as we possibly can to push back, to align ourselves with the attorney general’s office and to put tools in our tool belts to prevent this from getting out of hand, because what the Biden administration has done in a multitude of different categories is create mass chaos,” he said before devolving into a short rant about the border wall.

The mayor remained skeptical from the start.&nbsp;

“It’s not clear to me why Rolla needs to carry this banner when the problem, whether it’s the attorney general, the governor or whoever the hell else is up there, they need to sort this out,” Magdits said last month. “I don’t think it’s Rolla, Missouri’s responsibility to lead this charge.”

His opinion seemed to change little on Monday.&nbsp;

In fact, Dickson said after the meeting, Magdits “threatened to cut my nuts off” after he accused Magdits of siding with Planned Parenthood, even though Magdits during the meeting expressed frustration that Amendment 3 even made it on the ballot.

The Independent could not immediately reach the mayor for comment, but Rolla City Administrator John Butz confirmed he overheard part of the conversation.&nbsp;

“I was there and I heard it,” Butz said. “I think in the context the mayor wasn’t threatening him per se with that, I think it was in the side conversation the two of them were having. So I’ll leave it up to them to comment on the intent or the context of what was said.”

The next meeting is scheduled for Jan. 21. Dickson said he’s not yet decided if he will be there. But he’s also not giving up.

“When properly educated, the majority of council, I think, is going to want to pass this ordinance,” Dickson said. “… We’re going to keep on keeping on.”

And Rolla was their first stop.&nbsp;Rolla City Councilman Joshua Vroman, who filed the “sanctuary city” ordinance, said it&nbsp;doesn’t question the validity of Amendment 3, but rather makes note of an 1873 federal law on the books that bans mailing obscene material, including for the use of abortion.&nbsp;He worked on the latest draft of the ordinance with Brian Westbrook, with St. Louis-based Coalition Life, and Mark Lee Dickson, founder of Sanctuary Cities for the Unborn.<a href="https://uscode.house.gov/view.xhtml?req=granuleid:USC-prelim-title18-section1461&amp;num=0&amp;edition=prelim" target="_blank">The Comstock Act&nbsp;</a>outlaws the mailing of “obscene or crime-inciting” materials, including&nbsp;“every article or thing designed, adapted, or intended for producing abortion, or for any indecent or immoral use.”A number of Missouri elected officials,<a href="https://missouriindependent.com/2024/11/06/missouri-abortion-access-planned-parenthood-lawsuit-amendment-3/">&nbsp;including U.S. Sen. Josh Hawley</a>&nbsp;and&nbsp;<a href="https://x.com/MarkMaxwellTV/status/1853542335172546707" target="_blank">Missouri Attorney General Andrew Bailey,</a>&nbsp;have called on President Joe Biden to enforce the Comstock Act in regards to medication abortion. The Biden administration has refused.&nbsp;A renewed push for enforcement is expected when Donald Trump takes office again later this month. Trump’s prior administration did not enforce the law.“We’re pointing to the Comstock Act saying ‘here’s the law, you have to work within the confines of this law, and here is the enforcement mechanism,’” Vroman said.&nbsp;Magdits asked who would enforce the Rolla ordinance.&nbsp;“The citizens will enforce,”&nbsp;Vroman said, drawing several outbursts of laughter from the crowd followed by a call for decorum.Dickson, in an interview with The Independent, said law enforcement could not apply the ordinance, nor could a woman who receives and takes the medication be found liable under this ordinance.&nbsp;It would rely solely on citizens suing any person or organization who provides abortion medication.&nbsp;For example, he said, if an organization mailed abortion medication to a Rolla teenager, her parents could then sue the entity that mailed the medication.&nbsp;And if Planned Parenthood again began prescribing drugs for medication abortions, an individual could sue Planned Parenthood.&nbsp;The FDA has approved two medications —&nbsp;<a href="https://www.fda.gov/drugs/postmarket-drug-safety-information-patients-and-providers/information-about-mifepristone-medical-termination-pregnancy-through-ten-weeks-gestation" target="_blank">mifepristone and misoprostol&nbsp;</a>— for use in the first 10 weeks or pregnancy. The availability of both are under threat under the Comstock Act. Abortions performed after 10 weeks are done surgically.&nbsp;In the six months after the Dobbs decision, the number of&nbsp;<a href="https://missouriindependent.com/2024/03/25/more-than-26000-self-managed-abortions-may-have-occurred-post-dobbs-study-shows/">self-managed medication abortions rose by more than 26,000</a>&nbsp;across the U.S. according to a&nbsp;<a href="https://jamanetwork.com/journals/jama/fullarticle/10.1001/jama.2024.4266?utm_campaign=articlePDF%26utm_medium=articlePDFlink%26utm_source=articlePDF%26utm_content=jama.2024.4266" target="_blank">study</a>&nbsp;published in JAMA, the American Medical Association’s journal. The medication is mailed everywhere in the U.S., including Missouri.Vroman&nbsp;said the ordinance would only apply to elective abortions, not medically-necessary abortions.&nbsp;&nbsp;The ACLU of Missouri disagrees, saying in a written statement that the ordinance would also leave hospitals and providers vulnerable to lawsuits, including when treating miscarriages, which are medically documented as abortions and are often treated using mifepristone or misoprostol, both of which can be used to induce labor or stop hemorrhaging after childbirth.&nbsp;At one point during Monday night’s meeting, council members called upon Dr. Jenny Pennycook, an OB-GYN in Rolla, to explain her interpretation of the ordinance. She said she was trained at a Catholic Jesuit institution and has never been an abortion provider.&nbsp;Asked by council members if she believed the ordinance could create hurdles for miscarriage care, Pennycook said yes.Prior to the U.S. Supreme Court decision that overturned the constitutional right to an abortion in June 2022, Pennycook said she never had issues prescribing mifepristone or misoprostol.Since then, Pennycook said she’s had numerous patients turned away from pharmacies, leaving her needing to call to clear up that the medication was not for abortion so her patient could access it.“When pharmacists are scared about the Comstock Act and enforcement and whether or not they can dispense these medications, it makes it harder for patients to get these medications,” she said. “Untreated missed miscarriages can result in hemorrhage or infection and women can lose their uterus and never get pregnant again or even die.”<h2>Threat of ‘costly litigation’</h2>In a town that touts itself as “the middle of everywhere,” residents are wary of what could turn their&nbsp;<a href="https://www.rollacity.org/info/cd/comp2024-Rolla%20Initial%20Economic%20Indicators.pdf" target="_blank">recent economic and population growth</a>&nbsp;against them.&nbsp;“We did not simply pick Rolla out of a hat,” Westbrook told the council after multiple members accused him and Dickson of targeting the town. “We were invited, specifically for the things that you guys are discussing today.”Councilman Matt Fridley said while he opposes abortion, he doesn’t think it’s the responsibility of Rolla to resolve a state issue.&nbsp;“I understand from a philosophical or a moral compass where you’re coming from for this, but I don’t believe the city should fight for this,” he said. “ … It creates negative press. It creates problems where individuals may go, ‘I don’t want to live in this community.’”&nbsp;A few hours earlier, the council received a letter from the ACLU of Missouri that Magdits said he interpreted to mean: “this is a shot across the bow, and we’re watching what you’re doing.”The letter, signed by Tori Schafer, an attorney who helped steer Amendment 3 to victory, threatened “costly litigation.”&nbsp;“Rejecting this ordinance would demonstrate the city’s commitment to upholding the law and prioritizing the health and wellbeing of its community,” Schafer wrote. “Attempting to impose such a measure would invite expensive legal challenges, divert valuable city resources, and, most importantly, cause unnecessary harm and delay to individuals in need of critical health care.”&nbsp;<a href="https://www.washingtonpost.com/politics/2023/09/01/texas-abortion-highways/" target="_blank">Some Texas towns have also expressed concerns over litigation costs</a>&nbsp;when considering similar ordinances. In Rolla, Dickson proposed a workaround: a pro-bono attorney.Dickson said former solicitor general of Texas Jonathan Mitchel has agreed to represent the city of Rolla pro-bono if they are sued. But that’s only if the city agreed, and it would not cover the cost of additional legal representation.Much of the council’s confusion also centered around who could bring a lawsuit and where it would be litigated.&nbsp;Nathan Nickolaus, the city attorney, said he believes the ordinance would allow a citizen to sue anyone who they believe helped get abortion medication to a person in Rolla.“We’re saying you can’t do this in a state that says you can do this in a country that says you can’t do this,” Nickolaus said.&nbsp;That suit would likely end up in municipal court, he said, “which is woefully inadequate a place to hear this kind of case. No offense to anyone in the city — I used to be a municipal prosecutor — municipal court is kind of the McDonalds of the judicial system. It’s light kind of stuff.”&nbsp;Magdits on multiple occasions said the issue wasn’t whether or not the council opposes abortion. It was about legal repercussions.When he was called to the podium for public comments at the end of the meeting, Dickson said the issue at hand absolutely was abortion.“This really is a pro-life issue,” he said. “ … Are we going to stand with the attorney general of Missouri, or are we going to stand with the ACLU?”Magdits asked if the ordinance specified what kind of medication use would be subject to litigation.&nbsp;“It’s about abortion-causing drugs that cause abortion,” Westbrook said.“That’s a slick answer,” Magdits said, before concluding: “Go fight this somewhere else.”<h2>An icy greeting</h2>Dickson has spent much of the past few years of his life driving across the south pitching Sanctuary Cities for the Unborn to receptive audiences. But on Monday, as he ventured a bit further north, he received an icy response.&nbsp;It took him more than an hour to scrape the ice off his car. Then, he was greeted by a barrage of Rolla citizens who addressed him as a “carpetbagger.”&nbsp;Despite an ice and winter storm passing through the town less than 24 hours earlier, the meeting happened as planned. Some residents during public comments took note of the small crowd, blaming the council for holding the meeting on the same day the public school district called off classes.<a href="https://www.weareplannedparenthoodaction.org/a/pack-rolla-city-council" target="_blank">Planned Parenthood Great Rivers Action</a>&nbsp;called on citizens to show up wearing pink to protest the ordinance.&nbsp;“These bills intimidate abortion seekers and their loved ones, and waste taxpayers’ time and money just to score political points,” the release said.Rolla resident Britt Giger said she was used to the council’s “embarrassing, crazy, chaotic” meetings, but said Monday’s events could cause national embarrassment.&nbsp;“I don’t want to scroll TikTok and see this meeting,” she said, adding: “Imagine how university growth could be impacted if women don’t want to come here anymore.”She was followed by&nbsp;Jenny Cunningham&nbsp;who held her husband’s hand as she explained that they moved to Rolla about a year ago in the hopes of starting a family. When Amendment 3 passed, they breathed a sigh of relief. But news of this ordinance puts women back in the “crosshairs,” she said.“This is a bounty hunter law,”&nbsp;Cunningham&nbsp;said. “This turns citizen against citizen during the most terrible and tragic times that people can face in their lives.”&nbsp;Joe Dalton, founder and CEO of&nbsp;<a href="https://www.facebook.com/prcrolla" target="_blank">Pregnancy Resource Center of Rolla</a>, testified in support of the ordinance, emphasizing that Rolla citizens have access to abortion medication by mail despite the local Planned Parenthood currently being unable to prescribe it.&nbsp;He was followed by a registered nurse who works in Rolla in a labor and delivery unit who also supported the ordinance.&nbsp;“This would save the lives of countless children,” she implored the council.Pamela Timson, a resident of Rolla for more than 40 years, urged the council to set the ordinance aside for good, sharing her own story of a medical condition that made childbirth dangerous.She found it outrageous that Rolla would attempt to qualify a constitutional amendment so soon out of the gates.&nbsp;“We haven’t even given our state government a chance to qualify it yet,” she said.<h2>Vote stalled for now</h2>The council ultimately decided not to officially put the ordinance on the agenda for its next meeting. But Vroman still has the opportunity to bring his revised ordinance before the council during council comments later this month.Vroman brought the initial ordinance forward in November before recruiting Westbrook and Dickson to help him write a revised draft.&nbsp;At a Dec. 16 council meeting, Dominic Barceleau of the Missouri Attorney General’s office testified that state law does not prohibit Rolla from enacting such an ordinance.“It’s the intent of the legislature to regulate abortion to the fullest extent of the law,” Barceleau said. “The attorney general’s position is that doesn’t prevent concurrent municipal regulation that’s also consistent with the legislature’s intent to regulate abortion.”Dickson, who also drove up from Texas for that meeting, told council members the target of the ordinance was not just Planned Parenthood, but also pharmacies.&nbsp;“So when cities do this, it really is doing as much as we possibly can to push back, to align ourselves with the attorney general’s office and to put tools in our tool belts to prevent this from getting out of hand, because what the Biden administration has done in a multitude of different categories is create mass chaos,” he said before devolving into a short rant about the border wall.The mayor remained skeptical from the start.&nbsp;“It’s not clear to me why Rolla needs to carry this banner when the problem, whether it’s the attorney general, the governor or whoever the hell else is up there, they need to sort this out,” Magdits said last month. “I don’t think it’s Rolla, Missouri’s responsibility to lead this charge.”His opinion seemed to change little on Monday.&nbsp;In fact, Dickson said after the meeting, Magdits “threatened to cut my nuts off” after he accused Magdits of siding with Planned Parenthood, even though Magdits during the meeting expressed frustration that Amendment 3 even made it on the ballot.The Independent could not immediately reach the mayor for comment, but Rolla City Administrator John Butz confirmed he overheard part of the conversation.&nbsp;“I was there and I heard it,” Butz said. “I think in the context the mayor wasn’t threatening him per se with that, I think it was in the side conversation the two of them were having. So I’ll leave it up to them to comment on the intent or the context of what was said.”The next meeting is scheduled for Jan. 21. Dickson said he’s not yet decided if he will be there. But he’s also not giving up.“When properly educated, the majority of council, I think, is going to want to pass this ordinance,” Dickson said. “… We’re going to keep on keeping on.”

Missouri town rejects initial anti-abortion push to become ‘sanctuary city for the unborn’

TOPEKA — A Kansas legislator renewed attempts to rid the state of daylight saving time under a bill filed ahead of the state’s 2025 legislative session, which begins later this month.

<a href="https://www.kslegislature.gov/li/b2025_26/measures/sb1/" target="_blank">Senate Bill 1</a>, which was prefiled Friday, seeks to exempt Kansas from participating in the national practice of switching clocks back an hour every November and forward again every March.

Sen. Kenny Titus, a Wamego Republican who was elected to the Senate in November after serving a term in the House, is sponsoring the bill that would create year-round standard time beginning November 2025.

“Every year I get asked by constituents why the state doesn’t do something about switching clocks back and forth,” Titus said. “Most often I hear from folks that they don’t really care if we are on daylight saving or standard time, they just want to keep it consistent throughout the year.”

Recent attempts to put an end to the time changes at state and federal levels have failed. The last attempt in Kansas was in&nbsp;<a href="https://kansasreflector.com/2021/02/14/clock-is-ticking-ditch-the-switch-for-year-round-standard-or-daylight-saving-time/">2021</a>&nbsp;when Rep. Shannon Francis, a Republican from Liberal, drafted a resolution asking Congress to eradicate standard time and stick with daylight time year-round.

Only Arizona, Hawaii and the U.S.’s unincorporated territories are exempt from the switch.

In 2022, the U.S.&nbsp;<a href="https://kansasreflector.com/2022/03/15/u-s-senate-backs-shift-to-permanent-daylight-saving-time/">Senate</a>&nbsp;passed a bill that would’ve made daylight saving time permanent, but the U.S. House declined to take it up.&nbsp;

Despite the U.S. House’s resistance, Titus said, “it shows there is popular support to at least talk about making a change.”

A 2021 AP-NORC&nbsp;<a href="https://apnorc.org/projects/dislike-for-changing-the-clocks-persists/" target="_blank">poll</a>&nbsp;found that 75% of Americans want to stop switching their clocks, and studies have shown switching clocks can be detrimental to sleep habits and overall&nbsp;<a href="https://pmc.ncbi.nlm.nih.gov/articles/PMC7954020/" target="_blank">health</a>.&nbsp;

In comparing year-round daylight saving time to standard time, Titus found increased consumer spending was the primary benefit because of more daylight in the evening for shopping and activities. More daylight in the morning with year-round standard time, on the other hand, can lead to health benefits, he said.

“For me, it was a no-brainer to prioritize the health of Kansans,” Titus said.

President-elect Donald Trump vowed last month in a&nbsp;<a href="https://x.com/realDonaldTrump/status/1867686000711155989" target="_blank">post</a>&nbsp;to social media platform X that the Republican Party would attempt to eliminate daylight saving time, calling it “inconvenient” and “costly.” Titus’ bill provides for the possibility of Congress taking its own action.

His is the only Senate bill to be prefiled so far.&nbsp;

“The primary issue is fairly straightforward, so I thought it was best to get the conversation started before committee calendars are filled up with other topics,” he said.

Daylight saving time would end in Kansas under senator’s prefiled bill

TOPEKA –&nbsp;While the risk to the general public still remains very low, the Kansas Department of Health and Environment (KDHE) is reminding Kansans to practice caution around wild birds and backyard poultry amid increasing reports of highly pathogenic avian influenza (HPAI) A (H5N1) virus both nationally and within Kansas, according to a media release from the KDHE.

HPAI is primarily an infection of wild birds; however, in the ongoing outbreak beginning in early 2022, numerous animal species have been infected including domestic poultry, dairy cattle, wild carnivores like skunks and raccoons, and domestic cats. The virus is spread by migratory waterfowl, primarily ducks and geese.

“The public health risk of HPAI remains low,”&nbsp;KDHE Chief Medical Officer Dr. Dereck Totten said.&nbsp;“While there has been no person-to-person spread, KDHE is monitoring the situation carefully. We are working with people who have had flocks test positive and encourage the public to avoid contact with sick birds.”

Fall migration of wild birds increased in November and December, resulting in additional exposure to HPAI and thus an increase in cases in domestic poultry in Kansas. Since Dec. 3, the Kansas Department of Agriculture (KDA) has identified HPAI in six non-commercial backyard flocks and two commercial flocks.

Since this virus can infect humans who come in close contact with sick or dead birds and other infected animals, KDHE, in coordination with local health departments, monitors all exposed individuals for symptoms of influenza-like illness. While no human cases have been identified in Kansas, 66 cases of HPAI have been confirmed in humans in the United States in 2024. Those cases are nearly all from exposure to infected poultry or dairy cows, and no known human-to-human spread has occurred.

KDHE provides update on bird flu risk in Kansas

KANSAS CITY —Police are investigating a homicide in Kansas City that left three dead.

Just before 10p.m., police responded to the 1000 block of NW 91st Terrace in Kansas City on a reported check the welfare call for service, according to KCPD&nbsp;Sergeant Phil DiMartino.

When officers arrived they began checking the exterior of the residence. They smelled smoke and could see smoke inside the home. Officers made entry into the home but had to quickly back out due to a fire inside. 

The Kansas City Fire Department simultaneously responded and were able to extinguish the fire. Upon reentering the home, police found a girl, a boy and a man with an apparent gunshot wound. Emergency medical personnel declared the girl and the man deceased at the scene. 

EMS transported the boy to a local hospital where he died a short time later, according DiMartino.

&nbsp; This is being investigated as a homicide and detectives are not looking for any suspects. Investigators and crime scene personnel are working to determine what led up to the incident.&nbsp; &nbsp;Police released no additional details.

TOPEKA — The Kansas Attorney General’s Office blocked millions in school bond funds to a district in the state’s smallest county based on a rigid interpretation of a 2023 elections law.&nbsp;

Voters in the Greeley County school district, headquartered in Tribune near the state’s westernmost edge, approved in May a $4.6 million school bond for renovations and new construction, but the Attorney General’s Office refused to approve the funds.&nbsp;

“I feel like we have ignored a core tenet of our society and our government as a whole,” said John Niehues, the district superintendent. “You know, it’s the will of the people.”

The Attorney General’s Office determines whether any bond issue across the state meets legal standards. The Greeley County schools decision relied on a 2023 elections reform&nbsp;<a href="https://kslegislature.gov/li/b2023_24/measures/vote_view/je_20230406185329_890627/" target="_blank">bill</a>. It created a state law requiring county election officials to publish notice of an election three weeks in advance on a county election website, in addition to a traditional newspaper notice.&nbsp;

However, Greeley County, with a population of about 1,200, doesn’t have a website.

The office found the county clerk’s “non-compliance with the website notification” was equal to a failure to follow the law, said Danedri Herbert, a spokeswoman for the attorney general.&nbsp;

“This determination is purely one of compliance verification and not a judgment on the merits of or need for the bond in question,” she said.&nbsp;

It says “the real will of the people may not be defeated by any technical irregularity of any officer, whenever the greater number of votes were in favor of a question submitted.”Niehues, who has been at the district for about nine years and superintendent for four, said he was going to be OK no matter the result of the bond election. But with that acceptance also came mixed emotions.“I don’t like that I’m the tip of the spear on this — that we chose the smallest county in Kansas to make a point,” he said.Leading up to the May 21 primary, Niehues engaged the community to inform them about the bond, which would replace an old one and avoid tax increases for local property owners. Answers to frequently asked questions and in-depth information about the bond were — and still are — visibly posted on the school district&nbsp;<a href="https://tribuneschools.org/35934_1" target="_blank">website</a>.“There was no way anyone in Greeley County could not have known about this school bond,” said Jerri Young, the county clerk, who has acted as the county’s elections official for about 15 years.&nbsp;The elections law was poorly written, Young said. State law doesn’t require Kansas counties to operate a website, and no funding was attached to the 2023 bill to ensure they did.“I still don’t have one,” she said.&nbsp;Young said she met with Attorney General Kris Kobach and office staff. She said she felt the decision had been made before the meeting began.Outgoing state Sen. John Doll, a Garden City Republican whose district encompasses Greeley County, supported the 2023 elections bill at the time of its passage. Before leaving office, he said, he has attempted to help the district and the county remedy the situation without success. He said he didn’t consider how stringently the Attorney General’s Office would interpret it, even when small communities like Greeley County use their schools as sources of information.The 25-year bond issue would have funded a new gymnasium, renovations in the existing gym and a new accessible playground. A private, anonymous donor also promised to cover about 10% of the project, which totals more than $4.7 million.&nbsp;All now hangs in the balance as local officials wait to see if the 2025 legislative session might bring change.&nbsp;The district had limited options in how to proceed once the Attorney General’s Office refused to release the bond funds. The district could still take legal action, which Niehues isn’t fully in favor of. The Legislature could remedy the requirement through new or amended legislation. Or the district could hold another election, but there would be no guarantee that a majority of voters would approve a bond question a second time.&nbsp;“We did everything,” Young, the county clerk, said, “and the people voted. It was the will of the people.”
