Charlotte O’Hara, announced Tuesday she will seek the&nbsp;Republican nomination&nbsp;for&nbsp;governor&nbsp;in 2026, according to a media release.

O’Hara, a business woman and conservative Republican, stated in the release, she "is done with Kansas being the high tax point on the prairie. As Governor, she will focus on reining in state spending and ludicrous corporate welfare, ban DEI and get schools back to education.

&nbsp;Democrat Gov. Laura Kelly's second term is nearing an end. Kelly is term-limited from running again in 2026. In January,&nbsp;Kansas Secretary of State <a href="https://hayspost.com/posts/ec164f8e-f8d7-4438-9c64-8f8ebaa1c7ea">Scott Schwab of Overland Park announced </a>his intention&nbsp;to run for governor.

O’Hara has long fought corporate welfare/tax incentives, which increase property taxes for homeowners and small businesses, according to the media release from her campaign. 

O’Hara is a past Republican Party 3rd District Chairwoman and served in the Kansas House (2011-2012). She voted against Governor Brownback’s 7.5% increase in the 2012 General Fund budget and blew the whistle on Brownback’s acceptance of the federal Early Innovator Grant money to build the IT infrastructure for ObamaCare in Kansas.

O’Hara (2021-2025) served as Johnson County Commissioner, District 3, "where she refused to capitulate to COVID masks and vaccine mandates." She tirelessly fought against Democrat controlled Johnson County Commission’s spending frenzy.O’Hara emphasized, “The hidden increase of taxes through inflation has become extraordinarily draconian, especially property taxes. 

"While Democrats along with Republicans support corporate welfare/tax incentives, the rest of us have to pay our property taxes in full with no shelter. This hits all of our budgets, but especially those on fixed incomes, whose disposable income shrinks with every tax increase.”

Former state representative announces run for Kan. governor

RILEY COUNTY —Law enforcement are investigating an armed robbery and have a teen in custody.

Just before 2:30p.m. Wednesday, police arrested 17-year-old Delron Tyree, Jr. of Topeka, in the 6000 block of SW 10th Street in Topeka, according to a media release from the RCPD.

Tyree was taken into custody on a Riley County District Court warrant for aggravated robbery armed with a dangerous weapon and criminal use of weapons.

Following his arrest, Tyree was transported to the North Central Kansas Regional Juvenile Detention Facility. Tyree was confined at the time of this report.

TOPEKA — U.S. Rep. Sharice Davids of Kansas said President Donald Trump’s administration shouldn’t cancel a $2.4 billion contract with Verizon and transfer work on the Federal Aviation Administration’s traffic control system to presidential adviser Elon Musk’s own company.

Davids, the 3rd District Democrat who serves on the aviation subcommittee of the U.S. House Transportation and Infrastructure Committee, said the potential deal with Musk raised conflict-of-interest issues.

Starlink is part of Musk’s SpaceX satellite and rocket company — a business rival of Verizon. Musk also was hired by Trump to lead an effort to reduce federal government spending, including at the FAA.

“Elon Musk’s reported interference in a competitively awarded FAA contract is deeply concerning and raises serious questions about conflicts of interest,” Davids said. “Aviation safety — not private gain — must be the priority in our air traffic control system.”

Verizon was issued a 15-year contract in 2023 to integrate fiber-optic cables into the network allowing FAA facilities to communicate. The current federal air traffic control system is the responsibility of L3Harris, not Verizon, but Musk has repeatedly blamed Verizon for technology shortcomings.

“The administration must ensure federal contracts are awarded through a fair and transparent process, not at the whim of a billionaire with political ties to those in power,” Davids said.

In the past week, The New York Times, CNN and other news outlets reported Musk was interested in deploying his own company, Starlink, to operate the federal air traffic control system. The Trump administration has allowed Starlink equipment to be tested at at least two airports.

The issue of aviation safety was brought into focus for the Kansas congressional delegation Jan. 29 when American Airlines Flight 5342 originating from Eisenhower National Airport in Wichita collided mid-air with a U.S. Army helicopter while over the Potomac River in Washington, D.C.

All 67 people aboard the aircraft, including Kansans, were killed in the first major U.S. commercial passenger flight crash in more than 15 years.

In aftermath of the accident, members of the Kansas congressional delegation shared empathy for victims and their families and vowed to make certain the crash was thoroughly investigated. Five of the six members of the delegation took part in a moment of silence on the U.S. House chamber.

“Together, we commit to finding answers, and to working to ensure another tragedy like this doesn’t happen again,” said U.S. Rep. Ron Estes, a Republican serving the 4th District centered on Wichita.

Kansas Rep. Sharice Davids objects to Musk’s call for cancellation of $2.4 billion FAA contract

BUTLER COUNTY, MO—Authorities are investigating a fatal home explosion and fire that left two children dead in rural Butler, Missouri.

Just after 11:30p.m. Saturday, deputies responded to a 911 call of a home explosion and fire, according to the Bates County Sheriff’s Office.

First responders were met with a fully engulfed home. Five people were reported to be living at the residence.&nbsp; Three of the five occupants were able to make it out of the house. Two children both age 2 were not able to be immediately rescued. 

Fire units arrived on scene and requested assistance from additional agencies. Rescue efforts were unsuccessful due to the heavy fire in the residence. 

 Both children were eventually pronounced deceased by the Bates County Coroner on scene.   The three people that were able to make it out of the house were transported to the hospital for treatment.   The fire is being investigated by the Bates County Sheriffs Office and the Missouri State Fire Marshal’s Office.

Only surgical abortions will be offered initially as the clinics await state approval to restart medication abortions

Two of Missouri’s nine Planned Parenthood clinics are poised to start performing regularly-scheduled surgical abortions next week, though clinic leadership says access to medication abortions is in the hands of the state.&nbsp;

The first elective abortion in Missouri since the procedure was banned in 2022 was performed earlier this month in a Kansas City Planned Parenthood clinic. It will now be offering regular appointments for surgical abortions along with the clinic in Columbia, which has not offered the procedure since 2018.&nbsp;

Two weeks ago, Jackson County judge Jerri Zhang&nbsp;<a href="https://missouriindependent.com/2025/02/14/missouri-judge-blocks-discriminatory-abortion-clinics-rules-blamed-for-lack-of-access/">struck down the final few regulations for Missouri abortion providers</a>, calling them “unnecessary” and “discriminatory,” opening the door for abortions to resume.&nbsp;<a href="https://missouriindependent.com/2024/12/06/missouri-planned-parenthood-clinics-delay-abortion-amendment-3-lawsuit/">The regulations run afoul of the constitutional amendment</a>&nbsp;granting the right to abortion, which voters passed in November as Amendment 3.

Among these now defunct regulations is a requirement that abortion clinics submit a complication plan for medication abortions.

While Zhang blocked the regulations connected to the complication plan, the statute itself remains, said Emily Wales, president and CEO with Planned Parenthood Great Plains.&nbsp;

Wales said Planned Parenthood submitted a complication plan to the state last week, but there has been no indication as to how long it will take to review the plans. Until that approval arrives, medication abortions cannot begin, Wales said.&nbsp;

“I do not have an anticipated timeline for approval or denial of the pending complication plans,”&nbsp;Missouri Department of Health and Senior Services&nbsp;spokeswoman Sami Jo Freeman said in an email.

Freeman confirmed the plans were received from both Planned Parenthood affiliates the Thursday and Friday prior. &nbsp;

“We’re in uncharted territory here, because we don’t have regulations that tie to the statute, because they’re blocked,” Wales said. “I would be somewhat surprised if (the state) came back and said they are fine with the plan.”

<a href="https://www.guttmacher.org/2024/03/medication-abortion-accounted-63-all-us-abortions-2023-increase-53-2020" target="_blank">In 2023, 63% of abortions in the United States took place using medication</a>&nbsp;rather than surgical procedures, according to the Guttmacher Institute, a reproductive rights research group. That number is increasing as the number of states with bans and restrictions on abortions grow.&nbsp;

In states where abortion is legal, medication that induces a miscarriage is available to patients in their first trimester of pregnancy. Patients typically take two doses of medication, the second of which is often taken at home. In recent years, a growing number of women have been ordering abortion medication from online providers in the United States and abroad.

Wales said Planned Parenthood’s clinics in Kansas City and Columbia are stocked with abortion medication and ready to administer it as soon as the state allows. Leadership at the clinic in St. Louis said they are also ready to begin providing the medication as soon as the state green lights it.

“We are hoping that the state acts in good faith,” Wales said. “And recognizes that our process for managing complications is in line with the standard of care nationally.”

Abortions to resume in Columbia, Kansas City

The first elective abortion to take place in Columbia since 2018 is scheduled for Monday.

Nearly seven years ago, the clinic in central Missouri stopped seeing abortion patients after a new law required abortion providers to have admitting privileges at a nearby hospital.&nbsp;

Soon, appointments will be available at least one day a week.&nbsp;&nbsp;

The Kansas City clinic, located 125 miles west on Interstate 70, performed the first elective abortion in nearly three years in Missouri on Feb. 15. No other patients have undergone the procedure since.&nbsp;

But beginning Wednesday, the clinic will begin seeing patients for regularly-scheduled surgical abortions at least one day a week. Initially, they are scheduling patients up until 12 weeks in pregnancy, but Wales said they intend to expand the gestational age as they figure out scheduling.&nbsp;

The clinic also hopes to expand the pain management offered for surgical abortions. Initially, they plan to offer patients Valium and local anesthetic. Down the road Wales said they hope to also offer IV sedation.

The lag between the first abortion patient and the second was due to logistics. But weather and a holiday weekend also played a role.&nbsp;

A snowstorm that week forced the clinic to cancel other appointments and the physicians who came in to perform the first abortion hadn’t been scheduled to work the weekend of President’s Day. Instead, they offered to come in on their day off to take part in the historic moment.

While Columbia and Kansas City will only be offering appointments one day a week for the first couple months, both hope to expand as they adjust providers’ schedules and new staff physicians come on board.&nbsp;

Planned Parenthood Great Plains, which runs clinics in Kansas, Western Missouri and Oklahoma, has five physicians based in the Kansas City area. Wales said they hope to add at least one more staff physician in the coming months. The clinics also rely on a network of about half a dozen out-of-state contracted physicians to coordinate care at the clinics, which primarily includes contraceptives, STI testing, cancer screenings and wellness checks.&nbsp;&nbsp;&nbsp;

The equipment used in surgical abortions has been on a tri-state tour in recent years, Wales said. After the Columbia clinic ended the procedure, the equipment went to Oklahoma, which at the time was seeing a surge in Texans following that state’s 6-week ban. When Oklahoma’s ban went into effect, the equipment was sent to Kansas as more Texans and Oklahomans started traveling north for the procedure.&nbsp;

Wales said it’s not immediately clear what the demand for abortion appointments will be in Missouri. In 2023, Kansas saw a 58% increase in abortion appointments as bans took effect in neighboring states. Wales is anticipating the clinics in Columbia and Kansas City could see patients traveling in from Iowa, Arkansas and even Louisiana.&nbsp;

“One of the challenges for us is that we still have an overwhelming need in Kansas, and we’re going to have to take some time to figure out how patients travel,” Wales said. “If the demand is higher in Missouri, we will increase access there.”

No set date to begin abortions again in St. Louis

The Planned Parenthood clinic in St. Louis’ Central West End was the last clinic in Missouri to provide an abortion before Roe v. Wade was overturned.&nbsp;

Clinic leadership, wary of the ongoing court battle, has not yet started scheduling out abortion appointments in St. Louis.

Dr. Margaret Baum, interim chief medical officer for Planned Parenthood Great Rivers, which runs clinics in eastern and southern Missouri and southern Illinois, said it was too soon to provide a timeline of when surgical abortions will return to St. Louis.

“We moved all of our services to Illinois, our nursing staff, our anesthesia equipment, physician presence, all of those things,” she said. “So it’s going to take a little bit of time to bring things back to Missouri.”&nbsp;

The St. Louis location previously offered abortions up to 21 weeks, six days gestation. Baum said she imagines they will offer the procedure up until that point again once services restart.&nbsp;

A 20 minute drive across the river in Fairview Heights, Illinois, patients can be seen up to 28 weeks, six days gestation.

While a lot of uncertainty remains around surgical abortions, Baum said the St. Louis clinic is ready to start providing medication abortions as soon as the state clears them to do so.&nbsp;

But even though medication abortion is easier to provide — it requires fewer staff and less equipment —&nbsp;Baum said the clinics in Springfield and Rolla won’t be able to make the medication available to patients because neither clinic has doctors on staff, citing a state law that requires only physicians perform the procedure.&nbsp;

She said bringing physicians to Springfield and Rolla “is certainly a discussion, but “right now, we have to focus our physician power in our very, very busy service in Illinois, and bringing things back to Missouri.”

Baum is one of two long-term staff physicians and one contracted physician at Planned Parenthood Great Rivers.&nbsp;

When she started at Planned Parenthood in St. Louis several years ago, an ultrasound technician saw patients, then Baum reviewed the ultrasound images before moving on with the procedure. But then Missouri law changed and suddenly she was required to do the ultrasound, cutting into her time with other patients.&nbsp;

Then came the mandatory 72 hour waiting period between seeing a provider and having an abortion. That was followed by a requirement that the same physician who walked the patient through the required informed consent process also be the one to do their abortion 72 hours later.&nbsp;

Across the river in Illinois, there was no waiting period, no physician consent requirement and no pelvic exam required for medication abortions.&nbsp;

While Baum said Planned Parenthood celebrated the judge’s most recent decision, many are also wary of what the state could do next.&nbsp;

This legislative session, dozens of bills have been filed seeking to&nbsp;<a href="https://missouriindependent.com/2025/02/19/missouri-born-alive-survivors-bill-abortion-medication-lawsuits/">restrict Amendment 3.</a>&nbsp;This includes multiple proposed constitutional amendments seeking to&nbsp;<a href="https://missouriindependent.com/2025/02/05/missouri-abortion-ban-constitutional-amendment-stinnett-rape-incest-exception/">put an abortion ban on the ballot</a>&nbsp;as soon as this year.

“It is important to remember that while we celebrated this victory last Friday, it is temporary, so we are still a little bit nervous that things could change,” she said. “We don’t know what will happen in January, when the actual court case takes place. So before we put too much effort into reopening services in St. Louis, if things could then change, we still have to focus where we have this facility in Illinois, to keep that running.”&nbsp;

Legal battles continue to complicate planning

On Saturday, Attorney General Andrew Bailey filed a request for a temporary restraining order or preliminary injunction, asking a Cole County judge to temporarily halt the Columbia and Kansas City clinics from performing abortions. The state has been attempting to move Planned Parenthood’s lawsuit against the state from Jackson County to Cole County.

The filing is part of a separate lawsuit filed late last year by the attorney general’s office arguing that Planned Parenthood doesn’t have the grounds to sue because of a 2010 settlement agreement between Planned Parenthood and the state.&nbsp;

“More than anything, I think it’s an attempt to get out of a court where they’re unhappy with the outcomes they’re seeing,” Wales said. “But also to delay, distract and prevent Missourians from access and care.”

Planned Parenthood has requested that the case be transferred to Jackson County. A status hearing in the Cole County case is scheduled for March 12.

Bailey is also expected to appeal the most recent order out of Jackson County which allowed Planned Parenthood to restart surgical abortions.

In an email Tuesday, a spokeswoman for the attorney general said the office intends to appeal the judge’s Feb. 14 order “immediately.” As of Thursday, the office had not filed an appeal.

 </figure>BY:&nbsp;<a href="https://missouriindependent.com/author/annaspoerre/">ANNA SPOERRE</a> <a href="https://missouriindependent.com/briefs/missouri-senate-committee-advances-bill-to-ban-texting-while-driving/">Missouri Independent</a><h2>Only surgical abortions will be offered initially as the clinics await state approval to restart medication abortions</h2>Two of Missouri’s nine Planned Parenthood clinics are poised to start performing regularly-scheduled surgical abortions next week, though clinic leadership says access to medication abortions is in the hands of the state.&nbsp;The first elective abortion in Missouri since the procedure was banned in 2022 was performed earlier this month in a Kansas City Planned Parenthood clinic. It will now be offering regular appointments for surgical abortions along with the clinic in Columbia, which has not offered the procedure since 2018.&nbsp;Two weeks ago, Jackson County judge Jerri Zhang&nbsp;<a href="https://missouriindependent.com/2025/02/14/missouri-judge-blocks-discriminatory-abortion-clinics-rules-blamed-for-lack-of-access/">struck down the final few regulations for Missouri abortion providers</a>, calling them “unnecessary” and “discriminatory,” opening the door for abortions to resume.&nbsp;<a href="https://missouriindependent.com/2024/12/06/missouri-planned-parenthood-clinics-delay-abortion-amendment-3-lawsuit/">The regulations run afoul of the constitutional amendment</a>&nbsp;granting the right to abortion, which voters passed in November as Amendment 3.Among these now defunct regulations is a requirement that abortion clinics submit a complication plan for medication abortions.While Zhang blocked the regulations connected to the complication plan, the statute itself remains, said Emily Wales, president and CEO with Planned Parenthood Great Plains.&nbsp;Wales said Planned Parenthood submitted a complication plan to the state last week, but there has been no indication as to how long it will take to review the plans. Until that approval arrives, medication abortions cannot begin, Wales said.&nbsp;“I do not have an anticipated timeline for approval or denial of the pending complication plans,”&nbsp;Missouri Department of Health and Senior Services&nbsp;spokeswoman Sami Jo Freeman said in an email.Freeman confirmed the plans were received from both Planned Parenthood affiliates the Thursday and Friday prior. &nbsp;“We’re in uncharted territory here, because we don’t have regulations that tie to the statute, because they’re blocked,” Wales said. “I would be somewhat surprised if (the state) came back and said they are fine with the plan.”<a href="https://www.guttmacher.org/2024/03/medication-abortion-accounted-63-all-us-abortions-2023-increase-53-2020" target="_blank">In 2023, 63% of abortions in the United States took place using medication</a>&nbsp;rather than surgical procedures, according to the Guttmacher Institute, a reproductive rights research group. That number is increasing as the number of states with bans and restrictions on abortions grow.&nbsp;In states where abortion is legal, medication that induces a miscarriage is available to patients in their first trimester of pregnancy. Patients typically take two doses of medication, the second of which is often taken at home. In recent years, a growing number of women have been ordering abortion medication from online providers in the United States and abroad.Wales said Planned Parenthood’s clinics in Kansas City and Columbia are stocked with abortion medication and ready to administer it as soon as the state allows. Leadership at the clinic in St. Louis said they are also ready to begin providing the medication as soon as the state green lights it.“We are hoping that the state acts in good faith,” Wales said. “And recognizes that our process for managing complications is in line with the standard of care nationally.”<h2>Abortions to resume in Columbia, Kansas City</h2>The first elective abortion to take place in Columbia since 2018 is scheduled for Monday.Nearly seven years ago, the clinic in central Missouri stopped seeing abortion patients after a new law required abortion providers to have admitting privileges at a nearby hospital.&nbsp;Soon, appointments will be available at least one day a week.&nbsp;&nbsp;The Kansas City clinic, located 125 miles west on Interstate 70, performed the first elective abortion in nearly three years in Missouri on Feb. 15. No other patients have undergone the procedure since.&nbsp;But beginning Wednesday, the clinic will begin seeing patients for regularly-scheduled surgical abortions at least one day a week. Initially, they are scheduling patients up until 12 weeks in pregnancy, but Wales said they intend to expand the gestational age as they figure out scheduling.&nbsp;The clinic also hopes to expand the pain management offered for surgical abortions. Initially, they plan to offer patients Valium and local anesthetic. Down the road Wales said they hope to also offer IV sedation.The lag between the first abortion patient and the second was due to logistics. But weather and a holiday weekend also played a role.&nbsp;A snowstorm that week forced the clinic to cancel other appointments and the physicians who came in to perform the first abortion hadn’t been scheduled to work the weekend of President’s Day. Instead, they offered to come in on their day off to take part in the historic moment.While Columbia and Kansas City will only be offering appointments one day a week for the first couple months, both hope to expand as they adjust providers’ schedules and new staff physicians come on board.&nbsp;Planned Parenthood Great Plains, which runs clinics in Kansas, Western Missouri and Oklahoma, has five physicians based in the Kansas City area. Wales said they hope to add at least one more staff physician in the coming months. The clinics also rely on a network of about half a dozen out-of-state contracted physicians to coordinate care at the clinics, which primarily includes contraceptives, STI testing, cancer screenings and wellness checks.&nbsp;&nbsp;&nbsp;The equipment used in surgical abortions has been on a tri-state tour in recent years, Wales said. After the Columbia clinic ended the procedure, the equipment went to Oklahoma, which at the time was seeing a surge in Texans following that state’s 6-week ban. When Oklahoma’s ban went into effect, the equipment was sent to Kansas as more Texans and Oklahomans started traveling north for the procedure.&nbsp;Now, it’s back in Columbia.&nbsp;Wales said it’s not immediately clear what the demand for abortion appointments will be in Missouri. In 2023, Kansas saw a 58% increase in abortion appointments as bans took effect in neighboring states. Wales is anticipating the clinics in Columbia and Kansas City could see patients traveling in from Iowa, Arkansas and even Louisiana.&nbsp;“One of the challenges for us is that we still have an overwhelming need in Kansas, and we’re going to have to take some time to figure out how patients travel,” Wales said. “If the demand is higher in Missouri, we will increase access there.”<h2>No set date to begin abortions again in St. Louis</h2>The Planned Parenthood clinic in St. Louis’ Central West End was the last clinic in Missouri to provide an abortion before Roe v. Wade was overturned.&nbsp;Clinic leadership, wary of the ongoing court battle, has not yet started scheduling out abortion appointments in St. Louis.Dr. Margaret Baum, interim chief medical officer for Planned Parenthood Great Rivers, which runs clinics in eastern and southern Missouri and southern Illinois, said it was too soon to provide a timeline of when surgical abortions will return to St. Louis.“We moved all of our services to Illinois, our nursing staff, our anesthesia equipment, physician presence, all of those things,” she said. “So it’s going to take a little bit of time to bring things back to Missouri.”&nbsp;The St. Louis location previously offered abortions up to 21 weeks, six days gestation. Baum said she imagines they will offer the procedure up until that point again once services restart.&nbsp;A 20 minute drive across the river in Fairview Heights, Illinois, patients can be seen up to 28 weeks, six days gestation.While a lot of uncertainty remains around surgical abortions, Baum said the St. Louis clinic is ready to start providing medication abortions as soon as the state clears them to do so.&nbsp;But even though medication abortion is easier to provide — it requires fewer staff and less equipment —&nbsp;Baum said the clinics in Springfield and Rolla won’t be able to make the medication available to patients because neither clinic has doctors on staff, citing a state law that requires only physicians perform the procedure.&nbsp;She said bringing physicians to Springfield and Rolla “is certainly a discussion, but “right now, we have to focus our physician power in our very, very busy service in Illinois, and bringing things back to Missouri.”Baum is one of two long-term staff physicians and one contracted physician at Planned Parenthood Great Rivers.&nbsp;When she started at Planned Parenthood in St. Louis several years ago, an ultrasound technician saw patients, then Baum reviewed the ultrasound images before moving on with the procedure. But then Missouri law changed and suddenly she was required to do the ultrasound, cutting into her time with other patients.&nbsp;Then came the mandatory 72 hour waiting period between seeing a provider and having an abortion. That was followed by a requirement that the same physician who walked the patient through the required informed consent process also be the one to do their abortion 72 hours later.&nbsp;Across the river in Illinois, there was no waiting period, no physician consent requirement and no pelvic exam required for medication abortions.&nbsp;While Baum said Planned Parenthood celebrated the judge’s most recent decision, many are also wary of what the state could do next.&nbsp;This legislative session, dozens of bills have been filed seeking to&nbsp;<a href="https://missouriindependent.com/2025/02/19/missouri-born-alive-survivors-bill-abortion-medication-lawsuits/">restrict Amendment 3.</a>&nbsp;This includes multiple proposed constitutional amendments seeking to&nbsp;<a href="https://missouriindependent.com/2025/02/05/missouri-abortion-ban-constitutional-amendment-stinnett-rape-incest-exception/">put an abortion ban on the ballot</a>&nbsp;as soon as this year.“It is important to remember that while we celebrated this victory last Friday, it is temporary, so we are still a little bit nervous that things could change,” she said. “We don’t know what will happen in January, when the actual court case takes place. So before we put too much effort into reopening services in St. Louis, if things could then change, we still have to focus where we have this facility in Illinois, to keep that running.”&nbsp;<h2>Legal battles continue to complicate planning</h2>On Saturday, Attorney General Andrew Bailey filed a request for a temporary restraining order or preliminary injunction, asking a Cole County judge to temporarily halt the Columbia and Kansas City clinics from performing abortions. The state has been attempting to move Planned Parenthood’s lawsuit against the state from Jackson County to Cole County.The filing is part of a separate lawsuit filed late last year by the attorney general’s office arguing that Planned Parenthood doesn’t have the grounds to sue because of a 2010 settlement agreement between Planned Parenthood and the state.&nbsp;“More than anything, I think it’s an attempt to get out of a court where they’re unhappy with the outcomes they’re seeing,” Wales said. “But also to delay, distract and prevent Missourians from access and care.”Planned Parenthood has requested that the case be transferred to Jackson County. A status hearing in the Cole County case is scheduled for March 12.Bailey is also expected to appeal the most recent order out of Jackson County which allowed Planned Parenthood to restart surgical abortions.In an email Tuesday, a spokeswoman for the attorney general said the office intends to appeal the judge’s Feb. 14 order “immediately.” As of Thursday, the office had not filed an appeal.

Planned Parenthood to restart regular abortion appointments in Kansas City next week

TOPEKA — Two former leaders of a Kansas foster care provider have entered plea negotiations to avoid trial for allegedly bilking the organization out of millions of dollars, federal court records show.

A&nbsp;<a href="https://kansasreflector.com/2022/11/11/federal-grand-jury-indicts-former-kansas-foster-care-officials-on-fraud-charges/">grand jury indicted</a>&nbsp;former Saint Francis Ministries CEO Robert “Father Bobby” Smith and William Whymark, the organization’s former IT director, in November 2022 on charges of wire fraud, conspiracy, and money laundering with damages totaling at least $4.7 million.

A Feb. 25 court filing in the federal case shows “the parties are presently involved in plea negotiations and anticipate resolving this case without a trial.” The filing asks the court to authorize&nbsp;<a href="https://www.uscourts.gov/about-federal-courts/probation-and-pretrial-services/presentence-investigations" target="_blank">a presentence investigation report</a>, which a court officer prepares when a defendant pleads guilty in order to help the judge determine the appropriate sentence.

The report “would materially facilitate the parties’ ongoing plea negotiations by allowing them to quickly and efficiently identify areas of potential agreement, while simultaneously isolating any disputed loss issues that may truly require litigation,” the joint court filing said.

Under the charges included in the indictment, they could face a maximum sentence of 20 years in federal prison, plus fines and restitution.

Denny Marlin, spokesman for Saint Francis Ministries, said the organization wouldn’t comment “out of respect for the criminal justice system” and “to ensure we do not compromise the integrity of the legal process.”

“We look forward to its resolution and remain focused on our mission of providing healing and hope to children and families,” Marlin said.

Kansas Reflector&nbsp;<a href="https://kansasreflector.com/2020/12/04/kansas-agency-serving-3100-foster-children-accused-of-rampant-financial-mismanagement/">first reported</a>&nbsp;on&nbsp;<a href="https://kansasreflector.com/2020/12/15/kansas-based-foster-care-providers-financial-turmoil-cubs-tickets-amplify-concerns-in-nebraska/">allegations of misconduct</a>&nbsp;by Smith and Whymark shortly after they left Saint Francis Ministries in November 2020. An&nbsp;<a href="https://kansasreflector.com/2020/12/20/kansas-foster-care-leader-charged-469k-to-credit-cards-hid-financial-losses/">internal investigation</a>&nbsp;revealed excessive billing for IT services and charges by Smith for lavish personal expenses.

In 2022, Saint Francis sued Smith, Whymark and former general counsel David Shaffer, accusing them of operating a scheme to enrich themselves through fraudulent billing. The lawsuit identified Shaffer and Whymark as brothers.

The former employees denied the claims, and Smith countersued Saint Francis employees for defamation because of reporting by Kansas Reflector.

Saint Francis hired Smith, an Episcopal priest ordained in 2014 by the Diocese of Chicago, as president and CEO in 2014. From 2017 to 2020, according to the state lawsuit, Smith charged $442,276.17 on Saint Francis Ministries credit cards, “a significant portion of which funded lavish meals, entertainment, travel and gifts for him and his family.” Smith also paid a travel agency $57,125.43, “a majority of which had no legitimate business purpose or was grossly excessive,” the lawsuit said.

Shaffer for at least eight months billed Saint Francis both through his Chicago law firm and in his individual capacity, which the lawsuit characterizes as legal malpractice. From 2015 to 2019, Shaffer billed more than $1 million in legal fees to his law firm, and from 2018 to 2020 an additional $500,000 in payments to himself. Smith approved the “grossly excessive” invoices, the lawsuit said, including invoices for legal work unrelated to Saint Francis and $4,000 for moving and storage expenses for office furniture at his Chicago law firm.

Whymark wasn’t qualified to provide IT services, but Smith hired him as chief information officer and signed off on more than $11 million for services provided by Whymark’s IT company. The lawsuit said those services were “grossly deficient and overpriced.”

Whymark’s company outsourced work to build a content management system that wouldn’t function. In the fall of 2019, while Saint Francis was undergoing a financial audit, the system crashed and destroyed financial data. Whymark then wiped the hard drives, according to the lawsuit, and the organization spent an estimated $3.2 million to repair Whymark’s IT work.

At the time, Saint Francis Ministries was the largest foster care provider in Kansas, serving more than 3,000 foster kids.

By January 2020, the IT costs combined with a severely underbid contract to provide foster care services in Nebraska placed Saint Francis in financial peril. The organization survived in part by receiving a $10 million Payment Protection Program loan, which it wasn’t eligible for and never repaid, during the COVID-19 pandemic.

Last year, the Kansas Department for Children and Families awarded new foster care contracts and replaced Saint Francis as the provider for the Wichita region. Saint Francis continues to&nbsp;<a href="https://www.dcf.ks.gov/services/pages/mapfostercare.aspx" target="_blank">provide foster care services</a>&nbsp;for much of central and western Kansas.

Kansas one of 10 states refusing to embrace wider Medicaid eligibility

TOPEKA — Kansas Senate Democrats attempted Tuesday to insert Medicaid expansion into a bill increasing legislative oversight over public assistance programs.

The outcome was the same in the Kansas House when a Democrat sought to drop a Medicaid reform package into a state government budget bill.

Sen. Renee Erickson, a Wichita Republican, brought forth&nbsp;<a href="https://www.kslegislature.gov/li/b2025_26/measures/sb161/" target="_blank">Senate Bill 161</a>, which would require legislative approval for any changes to public assistance programs in Kansas if they seek to expand eligibility, increase costs to the state, request federal waivers or modify intellectual or developmental disability services.

A Democrat from Kansas City, Kansas, Sen. Pat Pettey, took the opportunity during floor debate on the bill to introduce an amendment that would adopt the Healthcare Access for Working Kansans, or HAWK, Act.

Democratic Gov. Laura Kelly and a handful of Democrats in the House and Senate announced in early February&nbsp;<a href="https://kansasreflector.com/2025/02/06/kansas-governor-takes-another-swing-at-joining-41-states-that-have-expanded-medicaid/">the HAWK Act’s introduction</a>&nbsp;into both chambers. It was the governor’s seventh time trying for Medicaid expansion.

The proposal drew support from Democrats and health advocacy groups, but that support was tinged with criticism for a work requirement baked into the act.&nbsp;

It did not receive a hearing this session, Pettey pointed out Tuesday.

“Medicaid expansion is not political,” she said, referencing survey data that shows most Kansans support expansion or widespread access to affordable health care.&nbsp;

Kansas is one of 10 holdout states that have not expanded Medicaid.

“It saves lives,” Pettey said. “It saves Kansans money. It stabilizes rural hospitals. It brings taxpayers’ money back to Kansas.”

Pettey said the state has passed up on more than $8 billion by refusing to expand KanCare, as Medicaid is known in Kansas.

Senate President Ty Masterson, an Andover Republican, pushed back.

“I agree that it is not partisan,” he said, “but there is a whole host of reasons not to do it.”&nbsp;

He acknowledged the lack of discussion on Medicaid expansion this session and encouraged it to take place, rather than block consideration of Pettey’s amendment.

“It’s not like Kansas isn’t getting its money back,” Masterson said. “Kansas is doing the right thing and putting the right people at the front of the line.”

Democrats’ efforts were unsuccessful without the support of a majority of Republicans. Pettey’s amendment&nbsp;<a href="https://www.kslegislature.gov/li/b2025_26/measures/vote_view/je_20250218133629_925711/" target="_blank">failed</a>&nbsp;with 12 in favor — three Republicans and nine Democrats — and 28 Republicans opposed. Republicans who voted in favor were freshman Sen. Mike Argabright of Olpe, Sen. Rick Billinger of Goodland and Sen. Brenda Dietrich of Topeka.

Members of the Kansas House deflected an attempt to insert Medicaid expansion into next year’s state budget bill. The maneuver failed by a wide margin following lengthy debate. It was stopped with a roll call vote of 34-82. Republicans hold an 88-37 majority over Democrats in the House.

Rep. Suzanne Wikle, D-Lawrence, proposed a plan that would extend health coverage to about 150,000 lower-income workers across the state without costing the state treasury.

Under the Affordable Care Act, the federal government must cover 90% of a state’s increased expenditures for Medicaid expansion. Congress adopted a supplemental incentive aimed at Kansas and other holdout states. The additional federal support would mean Kansas could save $78 million on Medicaid in the upcoming fiscal year by approving expansion.

“Budgets are a reflection of your priorities,” Wikle said. “Show me a budget and I’ll show you what you care about.”

Rep. Troy Waymaster, the Bunker Hill Republican who chairs the House Appropriations Committee, acknowledged the financial reality of Wikle’s proposal but urged lawmakers to reject her amendment.

“I recognize there might be some savings, but we need to vote this down,” Waymaster said. “If this were to pass, we’d have Medicaid expansion for one year. That’s it. Unless there is legislation that would pass in subsequent years.”

Rep. Nikki McDonald, D-Olathe, said it was frustrating House GOP leaders had again sought to stifle regular debate on fiscally responsible Medicaid expansion proposals in House committees and on the House floor. She urged rank-and-file Republicans to pressure their GOP leaders to bring about meaningful debate on Medicaid expansion rather than suppress an approach for improving access to affordable health care embraced by 40 states.

House members who didn’t believe it important to extend preventive health care to thousands of Kansans with modest incomes should take a different approach to Medicaid expansion, said Rep. Stephanie Sawyer Clayton, D-Overland Park.

“If you’re not going to vote for this out of a moral reason, you should at least vote for this out of a cold-hearted business decision to make sure that our workforce is as healthy as possible so we can make sure we are working them as much as possible to help our economy,” Sawyer Clayton said.

In the Senate, the underlying bill on government efficiency was passed despite criticism from Democrats.

Sen. Cindy Holscher, an Overland Park Democrat, called the bill “inefficient” and said it added “layers of bureaucracy for even the simplest program changes.”

“That red tape could result in thousands of Kansans being unable to get time-sensitive help,” she said.&nbsp;

When the Legislature is not in session, oversight of public assistance program changes would shift to the Legislative Coordinating Council, which consists of the governor and House and Senate leadership.&nbsp;

More than half a dozen advocacy organizations indicated their opposition to the bill at a hearing before the GOP-led Senate Committee on Government Efficiency, which was created in response to and modeled after the federal initiative under billionaire Elon Musk’s so-called Department of Government Efficiency, which is not actually a federal department. However, Shawnee Republican Sen. Mike Thompson indicated at the&nbsp;<a href="https://kansasreflector.com/2025/02/17/kansas-senates-efficiency-committee-embraces-trio-of-bills-aimed-at-state-spending/">hearing</a>&nbsp;the bill could be a solution to complaints over the Kelly administration’s pursuit of changes to intellectual and developmental disabilities programs.

During the hearing and again on the Senate floor, Holscher said the bill could put at risk Kansas’ existing share of Medicaid funds, more than $3 billion for fiscal year 2025. That could be the case if certain federal deadlines, such as those associated with payment rate adjustments, are not met.&nbsp;

Legislators pushed bills through the Senate at a rapid clip Tuesday ahead of a self-imposed deadline Thursday to pass all bills that originated within the chamber. Senators on Tuesday gave first-round approval to more than 40 bills.

Medicaid expansion amendments offered by Democrats fail in Kansas Senate, House

KANSAS CITY —The Kansas Highway Patrol shared two examples of how seat belts save lives.

Just after midnight Tuesday morning, Master Trooper Zeller,&nbsp;Kansas Turnpike Authority, arrived at the scene of a crash on Interstate 70 just before 38th Street in the Kansas City area, according to a social media report from the patrol.

The the driver of a pickup lost control of the vehicle. It struck a guardrail, and rolled multiple times landing on its roof in a ditch. The driver&nbsp; walked away to look for help. He had his seatbelt on and it saved his life.

The Patrol also reported a driver on Tuesday was traveling southbound on Interstate 435 near Midland Drive. The driver lost control of the vehicle. It rolled and the driver was kept safe inside the vehicle due to wearing their seatbelt.

KHP reminder: Seat belts save lives

KANSAS CITY– Employees with the IRS and the U.S. Postal Service are among three defendants who have been indicted by a federal grand jury for stealing and cashing a U.S. Treasury check, according to the United State's Attorney.

Sierra S. McCall, 31, of Independence, Mo., Jalen Koonce, 31, of Raytown, Mo., and Julian A. King, 31, address unknown, were charged in a three-count indictment returned under seal by a federal grand jury in Kansas City, Mo., on Thursday, Feb. 6. The indictment was unsealed and made public following Koonce’s arrest and initial court appearance on Friday, Feb. 7.

McCall is employed by the IRS as a customer contact representative. Koonce is employed by the U.S. Postal Service at the sorting facility where government checks are processed.

The federal indictment charges McCall, Koonce, and King together in one count of the theft of government property. The indictment alleges they aided and abetted each other to steal and cash a $72,236 U.S. Treasury check on Aug. 9, 2023.

The indictment also charges Koonce and King each with one count of money laundering related to financial transactions on Aug. 9, 2023, that involved the proceeds of the theft of government property.

The charges contained in this indictment are simply accusations, and not evidence of guilt. Evidence supporting the charges must be presented to a federal trial jury, whose duty is to determine guilt or innocence.

This case is being prosecuted by Assistant U.S. Attorney Paul S. Becker. It was investigated by Treasury Inspector General for Tax Administration (TIGTA) and the U.S. Postal Service – Office of Inspector General.

IRS, KC postal employees accused of stealing U.S. Treasury check

CASS COUNTY, Neb. —The Nebraska State Patrol announced that a Nebraska State Trooper died in the line of duty on Monday.

A motor vehicle crash occurred while the trooper and others were responding to another crash on Interstate 80 between Ashland and Greenwood, according to a statement from the patrol.&nbsp;

The Patrol asked the Sarpy County Sheriff’s Office to conduct the crash investigation.&nbsp;The name of the trooper has not been released or additional details of the incident.

As winter weather conditions continue across the state, the Nebraska Patrol urged all motorists to be safe if they must travel.

&nbsp;I-80 remains closed between mile markers 420 and 426.

Nebraska state trooper killed while responding to crash

SEDGWICK COUNTY&nbsp;— Authorities&nbsp;have identified the skeletal remains discovered on Dec. 16, in the 4800 block of South Clifton, according to a media release from the Sedgwick County Sheriff's office.

Through positive dental records and clothing, investigators have confirmed the remains belong to 46-year-old Dion Elliott Curry.

 Detectives determined that Curry was homeless and known to frequent the Oaklawn area. He was a registered offender and last reported to the Sheriff’s Office Offender Registration Unit in Jan. 2024. In Apr. 2024, Curry was reported missing to the Wichita Police Department.

As previously stated, a preliminary skeletal examination conducted by an anthropologist showed no signs of trauma, and no foul play is suspected in his death.

Curry had previous convictions in 2005 for felony criminal threat; sexually motivated, attempted aggravated sexual battery and criminal restraint, according to the Kansas Department of Corrections.

Sheriff’s IDs skeletal remains as registered Kansas sex offender

U.S. Army announcement on transgenders in the military

IRAQ—&nbsp;Iraqi Security Forces enabled by U.S. forces, conducted precision airstrikes in the vicinity of Kirkuk, Iraq, killing two ISIS operatives on Monday, according to a statement from the U.S. Central Command.

An initial post-strike clearance found the dead ISIS operatives, an explosive suicide belt, explosive material, and components of weapons destroyed in the strike.

IRAQ—&nbsp;Iraqi Security Forces enabled by U.S. forces, conducted precision airstrikes in the vicinity of Kirkuk, Iraq, killing two ISIS operatives on Monday, according to a statement from the U.S. Central Command.An initial post-strike clearance found the dead ISIS operatives, an explosive suicide belt, explosive material, and components of weapons destroyed in the strike."The Iraqi Security Forces-led operation is part of the ongoing Defeat-ISIS campaign to disrupt and degrade ISIS' capabilities, dismantle their attack networks, and ensure the enduring defeat of ISIS. Coalition Joint Task Force - Operation Inherent Resolve (CTF-OIR) enabled ISF during the operation by providing technical support and intelligence."

 Sophia Franklin, 16,&nbsp; was last seen at her residence at 9:00p.m. February 2, according to the Alert.

She is believed to be with Gary F. Day. He was last seen at her residence just before 8a.m. February 3. There is a no contact order for Gary and Sophia. Sophia is 3 months pregnant.
