LINCOLN —&nbsp;Nebraska is following in Oklahoma’s footsteps after Gov. Jim Pillen established a “Women’s Bill of Rights” that will limit certain legal definitions for transgender Nebraskans.

Pillen announced the executive order Wednesday, the second signed by a U.S. governor establishing a Women’s Bill of Rights. The order defines a person’s “sex” as either male or female at birth. It applies to the executive branch, including state agencies, boards and commissions.

A “female” is defined as someone whose biological reproductive system is developed to produce ova and a “male” as someone whose biological reproductive system is developed to fertilize the ova of a female.&nbsp;

The order also provides definitions for “woman” and “girl,” “man” and “boy” and “mother” and “father.”

“It is common sense that men do not belong in women’s only spaces,” Pillen said in a statement. “As Governor, it is my duty to protect our kids and women’s athletics, which means providing single-sex spaces for women’s sports, bathrooms, and changing rooms.”

An executive order does not carry the weight of a legislative act or judicial ruling, but it does provide guidance to agencies such as the Department of Health and Human Services.&nbsp;<a href="https://nebraskaexaminer.com/briefs/nebraska-lawmakers-approve-dr-timothy-tesmer-as-state-chief-medical-officer/">Dr. Timothy Tesmer</a>, the state’s chief medical officer, is charged with&nbsp;<a href="https://nebraskaexaminer.com/2023/05/10/final-say-on-nebraska-gender-care-legislation-would-be-delegated-to-executive-appointee-and-dhhs/">drafting rules and regulations</a>&nbsp;regarding health care for trans youth following&nbsp;<a target="_blank" href="https://nebraskalegislature.gov/bills/view_bill.php?DocumentID=49961">Legislative Bill 574</a>&nbsp;this spring.

Oklahoma became first state earlier this month

Oklahoma Gov. Brian Stitt was the&nbsp;<a target="_blank" href="https://www.pbs.org/newshour/nation/how-a-new-womens-bill-of-rights-in-oklahoma-targets-trans-rights">first to sign</a>&nbsp;a “Women’s Bill of Rights” on Aug. 1, stating that Oklahomans were “fed up with attempts to confuse the word ‘woman’ and turn it into some kind of ambiguous definition that harms real women.”

Riley Gaines, a former University of Kentucky swimmer, has led efforts to legislative participation in women’s sports and joined Stitt when he signed his order this month.&nbsp;

Gaines gained national attention following the 2022 NCAA championship in the 200 freestyle when she tied for fifth place with Lia Thomas, a University of Pennsylvania swimmer who was the first openly trans woman to compete in the women’s events.&nbsp;

She has traveled the country and encouraged policymakers at all levels to address women’s sports, including Pillen and other Nebraskans during an Aug. 27&nbsp;<a href="https://nebraskaexaminer.com/2023/08/28/spiritual-warfare-former-kentucky-swimmer-encourages-nebraska-to-restrict-trans-athletes/">speech</a>&nbsp;in La Vista. Gaines brought up Stitt’s order, and Pillen said he would look at a similar one right away.

Order could put certain funding in jeopardy

State Sen. Megan Hunt of Omaha, who fought back this spring&nbsp;<a href="https://nebraskaexaminer.com/2023/05/19/nebraska-passes-stricter-abortion-ban-limits-on-gender-affirming-care/">against legislation</a>&nbsp;that curbed minors’ access to gender-affirming care, said her initial concern is how Pillen’s order could impact Nebraska’s ability to receive federal funding.

Funding for domestic violence shelters and rape crisis centers, for example, has stipulations to protect trans survivors.

“I guess that Gov. Pillen probably hates the fact that trans people would ever be protected or safe anywhere in Nebraska, but that’s how it works today,” Hunt said. “And by putting this kind of messaging out, by making this part of his official policies and positions of his administration, he’s putting funding for those services in danger in Nebraska.

“This really rises above just a rhetorical argument or a discriminatory opinion that he has or his own personal bigotry,” Hunt continued.

Hunt said a loss of funding would hurt women and children who are not trans, including possible supporters of Pillen, “more than anybody else.”

Jane Seu, legal and policy counsel for the ACLU of Nebraska, said the organization is disappointed that Pillen has continued “to push a divisive and harmful agenda” singling out and attacking trans, nonbinary and intersex Nebraskans.

“We are reviewing this executive order and want every trans, nonbinary and intersex Nebraskan to know we will continue to fight for their belonging and inclusion,” Seu said in a statement.

Pillen’s order requires that public schools or school districts and state agencies, departments or offices that collect demographic information identify individuals as either male or female at birth.&nbsp;

Hunt said that whether trans people are counted, they’ll continue to exist in Nebraska.

Pillen’s order takes effect immediately and will expire only if a state law takes effect governing athletic participation on the basis of sex and prescribing situations when single-sex services or facilities should be provided.&nbsp;

<a target="_blank" href="https://nebraskalegislature.gov/bills/view_bill.php?DocumentID=49722">Legislative Bill 575</a>, the “Sports and Spaces Act,” would&nbsp;<a href="https://nebraskaexaminer.com/2023/02/13/proposed-restrictions-on-nebraska-school-bathrooms-sports-teams-trigger-tense-hearing/">define</a>&nbsp;K-12 bathrooms, locker rooms and sporting teams as male or female based on sex at birth. That bill has&nbsp;<a href="https://nebraskaexaminer.com/2023/06/22/a-growing-number-of-nebraska-lawmakers-seeks-to-avoid-another-fight-on-trans-youth-in-2024/">not advanced</a>&nbsp;from the Education Committee, but State Sen. Kathleen Kauth of Omaha, the bill’s sponsor, said it will be her personal priority in 2024.

“I think it’s great!!” Kauth said in a text regarding Pillen’s order.

Nebraska enacts second governor-led ‘Women’s Bill of Rights’

SEDGWICK COUNTY —Law enforcement authorities are investigating another deadly shooting in Wichita.

Just before 11a.m. Wednesday, police were dispatched to a reported shooting at an apartment complex in the 2000 block of S. Seneca in Wichita, according to Officer Kris Gupilan.&nbsp;

First responders&nbsp; located&nbsp;69-year-old James Gibson of Wichita with gunshot wounds inside an apartment. He was pronounced deceased at the scene.&nbsp;&nbsp;

Police have not reported any suspect details or an arrest.

Homicide: 69-year-old Kansas man found dead in apartment

MARION (AP) —One of the reporters who works at the small Kansas newspaper that was&nbsp;<a href="https://apnews.com/article/marion-kansas-newspaper-raid-aca057365ea3925328a69acd615c9893">raided by authorities</a>&nbsp;earlier this month filed a federal lawsuit against the police chief Wednesday.

Deb Gruver believes Marion Police Chief Gideon Cody violated her constitutional rights when he abruptly snatched her personal cellphone out of her hands during a search where officers also seized computers from the Marion County Record's office, according to the lawsuit. That Aug. 11 search and two others conducted at the homes of the newspaper's publisher and a City Council member have thrust the town into the center of a&nbsp;<a href="https://apnews.com/article/marion-county-record-kansas-newspaper-raid-f1e49c4e542ddb3cf19c9ca02a0a21fb">debate over the press protections</a>&nbsp;in the First Amendment.

Cody didn't immediately respond to an email or text message from The Associated Press on Wednesday seeking comment. He has said little publicly since the raids other than posting a defense of them on the police department's Facebook page. In&nbsp;<a href="https://apnews.com/article/newspaper-raid-kansas-affidavit-07d9c856894892bff13cb014248ec866">court documents</a>&nbsp;he filed to get the search warrants, he argued that he had probable cause to believe the newspaper and City Council member Ruth Herbel, whose home was also raided, had violated state laws against identity theft or computer crimes.

But the newspaper's publisher, Eric Meyer, has said he believes the identity theft allegations provided a convenient excuse for the search, and the police chief was really upset about Gruver's investigation into his background with the Kansas City, Missouri, Police Department before he was hired in Marion earlier this year. Meyer has said he plans to file his own lawsuit.

The Record is known for its aggressive coverage of local politics and its community of 1,900 people about 150 miles (161 kilometers) southwest of Kansas City, Missouri.

Gruver — a veteran reporter with more than three decades of experience — said in a statement that by filing her lawsuit “I’m standing up for journalists across the country." She has previously worked at other newspapers in Kansas, Wyoming and Indiana and has won awards for her reporting.

“It is our constitutional right to do this job without fear of harassment or retribution, and our constitutional rights are always worth fighting for,” said Gruver, who had the words “Freedom of the press” tattooed on her right forearm the same day her lawsuit was filed.

The city administrator directed questions about the lawsuit to its attorney, Brian Bina, and outside council, Jennifer Hill. Neither attorney immediately returned phone messages from The Associated Press seeking comment.

The police department’s investigation of the newspaper began after a local restaurant owner accused reporters of improperly using personal information to access details about the status of her suspended driver’s license and her record that included a DUI arrest. A spokesman for the agency that maintains those records&nbsp;<a href="https://apnews.com/article/kansas-newspaper-raid-marion-county-record-ce9a8b98f05e2c4faef14e7ad6948316">has said</a>&nbsp;the reporter's search on a public website was likely legal.

The lawsuit says that the warrant expressly said that the search was supposed to focus only on equipment that was used to access those records, which was done by another reporter at the paper. But after Cody handed Gruver a copy of the warrant and she told him that she needed to call the publisher, he quickly grabbed her personal phone and took it.

“In seizing Ms. Gruver’s personal cellular phone despite the seizure exceeding the scope of the unreasonable and unlawful search warrant, Chief Cody acted in unreasonable and unnecessarily violent fashion, causing injury to plaintiff’s Gruver’s rights and her person,” the lawsuit said.

One of the officers even read Gruver, another reporter and an office administrator their Miranda rights even though they were never arrested before forcing them outside in the heat to watch the three-hour search.

After the search of the newspaper office, officers went on to search the home Meyer shared with his 98-year-old mother.&nbsp;<a href="https://apnews.com/article/kansas-newspaper-mother-raid-video-4427af3241da82767deb76028836cffd">Video of that raid</a>&nbsp;shows how distraught his mother became as officers searched through their belongings. Meyer said he believes that stress contributed to the death of his mother, Joan Meyer, a day later.

<a href="https://apnews.com/article/kansas-newspaper-raid-marion-county-record-bead3f49d323c784d40154067141dc7c">Legal experts believe</a>&nbsp;the raid on the newspaper violated a federal privacy law or a state law shielding journalists from having to identify sources or turn over unpublished material to law enforcement.

Authorities returned the computers and cellphones they took during the raids after the prosecutor decided there was insufficient evidence to justify their seizure. A judge ordered investigators Tuesday to also&nbsp;<a href="https://apnews.com/article/kansas-newspaper-raid-first-amendment-f8f375dbf48b93fc15c12893b8b49f37">destroy electronic copies</a>&nbsp;they made of the newspaper's files.

The Kansas Bureau of Investigation is looking into the newspaper's actions, but it hasn't provided any updates on its investigation.

It's not clear what action local officials might take. The City Council refused to discuss the raids at its meeting last week, and the mayor has told the Record that he doesn’t plan to take any action in response to them until after the KBI completes its investigation.

Kan. reporter files federal lawsuit against police chief who raided office

SEDGWICK COUNTY —Three people avoided injured in a small plane incident just before 1p.m. Wednesday in Wichita.

The Kansas Highway Patrol reported a fixed-wing single-engine Cessna 210 piloted by Lee S.&nbsp;McLeod, 42, Anaheim, California, departed Eisenhower Airport. 

The aircraft experienced power failure, according to airport officials. The cotrol tower reported seeing smoke coming from the engine.&nbsp;

 The aircraft went down in a field north of the east airport runway. McLeod and two passengers from Kansas were not injured. The cause of the incident remains under investigation.

SEDGWICK COUNTY —A Kansas man has been sentenced to 10 years in prison for the&nbsp;rape of a 72-year-old woman&nbsp;two years ago.

On Friday a judge sentenced 33-year-old Jeremy Brown of Valley Center to 10 years in prison, according to the Sedgwick County District Attorney's office.&nbsp; In March, a jury found guilty on four counts of rape.

Just before 4:30a.m. June 26, 2021, police responded to a report of rape at a home in the 1600 block of South St. Paul Street in Wichita, according to Officer Charley Davidson and contacted a 72-year-old woman identified as a victim.

Investigators learned the 72-year-old woman was with a 37-year-old woman and a 45-year-old man at a local bar where they met Jeremy Brown and then all four met at a home on St. Paul Street. At the residence, Brown sexually assaulted the 72-year-old. Brown also is required to register as a sex offender for life.&nbsp;

Last week, a powerful gang opened fire&nbsp; on a large group of parishioners led by a pastor as they marched through a community armed with machetes to rid the area of gang members.

The attack was filmed in real time by journalists at the scene, and several people were killed and others injured, Marie Yolène Gilles, director of human rights group Fondasyon Je Klere, told The Associated Press.

She watched online as hundreds of people from a local church marched through Canaan, a makeshift town in the outskirts of the capital of Port-au-Prince founded by survivors who lost their homes in the&nbsp;<a href="https://apnews.com/article/science-caribbean-haiti-earthquakes-1b24808399bf07fe955e739dad93f6e2">devastating 2010 earthquake</a>.

Canaan is controlled by a gang led by a man identified only as “Jeff,” who is believed to be allied with the “5 Seconds” gang.

Gangs have grown more powerful since the&nbsp;<a href="https://apnews.com/article/haiti-president-jovenel-moise-killed-b56a0f8fec0832028bdc51e8d59c6af2">July 2021 assassination of President Jovenel Moïse</a>, and they are estimated to control up to 80% of Port-au-Prince.

Gédéon Jean, director of Haiti’s Center for Analysis and Research in Human Rights, told the AP that he also watched the event unfold online and planned to ask the Ministry of Justice to investigate.

He accused the pastor of being irresponsible because he “engaged a group of people and put them in a situation like this.”

The parishioners who clutched machetes and yelled “Free Canaan!” were no match for gang members armed with assault rifles.

“Police should have stopped them from going,” Jean said. “It’s extremely horrible for the state to let something like this happen.”

A spokesperson for Haiti’s National Police did not return a message for comment.

From Jan. 1 until Aug. 15, more than 2,400 people in Haiti were reported killed, more than 950 kidnapped and another 902 injured, according to the most recent United Nations statistics.

Fed up with the surge in gang violence,&nbsp;<a href="https://apnews.com/article/haiti-gangs-vigilantes-street-justice-crime-murder-7c3fcdfeec012c80d1fc9e58c61ed7cc">Haitians organized a violent movement</a>&nbsp;in April known as “bwa kale” that targets suspected gang members. More than 350 people have been killed since the uprising began, according to the U.N.

 Flights fill up quickly and seats may only be available several days or even weeks in advance of departure.  Given that there may be a limited number of seats, U.S. citizens should consider booking flights in advance.

State Dept tells Americans to leave Haiti immediately

SHERMAN COUNTY —A northwest Kansas community is mourning the loss of their police chief.

The City of Goodland released a statement Wednesday afternoon to residents and the surrounding community:

It is with a heavy heart that we inform you of the passing of one of our own, Chief Frank Hayes, Jr.&nbsp; passed away from medical complications Wednesday morning, after dedicating his life to serving and protecting our city.&nbsp; He was 53 years old.&nbsp;&nbsp;

"Chief Hayes, known by the community as “Frankie”, served our community with unwavering loyalty and devotion. TOPEKA — State regulators say a detailed financial audit shows Evergy’s proposed $218 million rate hikes are unjustified.

The Kansas Corporation Commission on Tuesday announced its staff had determined Evergy should lower rates in the Kansas City area and slightly increase rates for the rest of the state.

The investor-owned utility, which serves about 1.6 million customers in Kansas and Missouri, asked to raise rates in April, following a five-year moratorium on rate increases. The moratorium was part of the agreement when regulators approved the 2018 merger of Westar and Kansas City Power &amp; Light.

Evergy asked for a 1.95% rate increase, which would generate $14.1 million in revenue, for the Kansas City, Kansas, region. But on Tuesday, regulators said a decrease of 7.32%, or $54.1 million, would be appropriate.

Regulators also bucked the utility’s request to raise monthly bills by $14.24 in the Kansas region, which&nbsp;includes Topeka, Wichita, Salina and other eastern parts of the state. The utility wants a 9.77% rate increase for $204.1 million in new revenue.

The Kansas Corporation Commission staff said a 1.66% increase, or $34.7 million, “was all that could be justified” for the region.

Tuesday marked the deadline for direct testimony to be filed by all involved&nbsp;in the proposal, but commissioners are still a few months away from a final decision on Evergy rate increases.&nbsp;Among other steps, the process will involve a settlement conference to determine if the parties can agree on a resolution to submit for the commission’s approval, followed by either a settlement hearing or evidentiary hearing before the commission.

“While an important part in the process, these results are far from final at this stage,” the KCC said in a news release Tuesday.

When making the ask, Evergy officials told state regulators the raise was needed to keep up with system upgrades, power plant investments and inflation, among other costs. Evergy’s status as a regulated utility allows it to adjust rates to recoup costs of building power plants and distribution infrastructure.

At the time of the 2018 merger, Evergy officials claimed they could squeeze out enough efficiencies to save ratepayers billions of dollars and&nbsp;<a target="_blank" href="https://www.cjonline.com/story/news/politics/state/2018/06/27/capitol-insider-podcast-westar-kcpampl-officials-say-merger-will-keep-rates-stable-for-15-years/11645915007/">stabilize rates for 15 years</a>.

In the central region, Evergy serves about 736,000 customers. In the Kansas metro area, the utility serves approximately 273,000 customers.&nbsp;

A final decision is expected in December or January.&nbsp;

Evergy’s proposed rate increases are too high, Kansas regulators announce

DEDHAM, Mass. (AP) — A judge ruled Wednesday that a 93-year-old former&nbsp;<a href="https://apnews.com/article/theodore-mccarrick-ex-cardinal-scandal-989fb97f4f0cad8c4926e8cb795ba2bf">Roman Catholic cardinal</a>&nbsp;is not competent to stand trial after both prosecutors and defense attorneys determined he suffers from dementia, and dismissed charges he sexually assaulted a teenage boy in Massachusetts decades ago.

<a href="https://apnews.com/article/lifestyle-religion-sexual-abuse-by-clergy-53924dd479cab20f7a11cb7eb47f686d">Theodore McCarrick</a>, the ex-archbishop of Washington, D.C., was defrocked by&nbsp;<a href="https://apnews.com/article/pope-francis-east-timor-vatican-city-religion-728a5af6ec4d36e54794a761fddd3fc4">Pope Francis</a>&nbsp;in 2019 after an internal Vatican investigation determined he sexually molested adults as well as children. The case created a credibility crisis for the church, as the Vatican had reports from authoritative cardinals dating to 1999 that McCarrick’s behavior was problematic, yet he became an influential cardinal, kingmaker and emissary of the Holy See’s “soft diplomacy.”

The once-powerful American prelate faced charges that he abused the teenage boy at a wedding reception at Wellesley College in 1974.

During Wednesday's hearing, a psychologist hired by the prosecution said she found significant deficits in McCarrick’s memory during two interviews in June, and he was often unable to recall what they had discussed from one hour to the next. Dr. Kerry Nelligan said she administered a number of tests on two occasions in June. As with any form of dementia, she said there are no medications that could improve the symptoms.

“It’s not just that he currently has these deficits,” Nelligan said. “There is no way they are going to get better.”

Without being able to remember discussions, he could not participate with his lawyers in his defense, she said.

McCarrick appeared via a video link during the hearing. He was slightly slumped in his chair wearing a light green shirt and what appeared to be a grey sweater vest or sweater around his shoulders. He did not speak during the hearing.

McCarrick has maintained that he is innocent, and&nbsp;<a href="https://apnews.com/article/lifestyle-religion-sexual-abuse-by-clergy-fe52aa3c7e9766599b191e14c7360752">pleaded not guilty in September 2021</a>. He was also&nbsp;<a href="https://apnews.com/article/cardinal-mccarrick-abuse-charges-wisconsin-4c931d1ef3faee7819633e5a8435dc17">charged in April</a>&nbsp;with sexually assaulting an 18-year-old man in Wisconsin more than 45 years ago.

In February, McCarrick’s attorneys asked the court to dismiss the case, saying a professor of psychiatry and behavioral science at the Johns Hopkins University School of Medicine had examined him and concluded that he has dementia, likely Alzheimer’s disease.

At that time, lawyers said McCarrick had a “limited understanding” of the criminal proceedings against him.

McCarrick, who lives in Dittmer, Missouri, was charged with three counts of indecent assault and battery on a person over 14. He was not exempt from facing charges because the clock stopped on the statute of limitations when he left Massachusetts.

Mitchell Garabedian, a well-known lawyer for clergy sexual abuse victims who is representing the man accusing McCarrick, said in June that his client was discouraged by the prosecution expert’s findings.

“In spite of the criminal court’s decision today,” Garabedian said following Wednesday's hearing, “many clergy sexual abuse victims feel as though former Cardinal Theodore McCarrick is and will always be the permanent personification of evil within the Catholic Church.”

The Associated Press generally does not identify people who report sexual assault unless they agree to be named publicly, which the victim in this case has not done.

The accuser told authorities during a 2021 interview that McCarrick was close to the man’s family when he was growing up. Prosecutors say McCarrick would attend family gatherings and travel on vacations with them and that the victim referred to the priest as “Uncle Ted.”

Prosecutors say McCarrick abused him over several years including when the boy, who was then 16, was at his brother’s wedding reception at Wellesley College. The man said McCarrick also sexually assaulted him in a coat room after they returned to the reception.

Prosecutors say McCarrick told the boy to say the “Hail Mary” and “Our Father” prayers before leaving the room.

(AP) — A judge ruled Wednesday that a 93-year-old former&nbsp;<a href="https://apnews.com/article/theodore-mccarrick-ex-cardinal-scandal-989fb97f4f0cad8c4926e8cb795ba2bf">Roman Catholic cardinal</a>&nbsp;is not competent to stand trial after both prosecutors and defense attorneys determined he suffers from dementia, and dismissed charges he sexually assaulted a teenage boy in Massachusetts decades ago.<a href="https://apnews.com/article/lifestyle-religion-sexual-abuse-by-clergy-53924dd479cab20f7a11cb7eb47f686d">Theodore McCarrick</a>, the ex-archbishop of Washington, D.C., was defrocked by&nbsp;<a href="https://apnews.com/article/pope-francis-east-timor-vatican-city-religion-728a5af6ec4d36e54794a761fddd3fc4">Pope Francis</a>&nbsp;in 2019 after an internal Vatican investigation determined he sexually molested adults as well as children. The case created a credibility crisis for the church, as the Vatican had reports from authoritative cardinals dating to 1999 that McCarrick’s behavior was problematic, yet he became an influential cardinal, kingmaker and emissary of the Holy See’s “soft diplomacy.”The once-powerful American prelate faced charges that he abused the teenage boy at a wedding reception at Wellesley College in 1974.During Wednesday's hearing, a psychologist hired by the prosecution said she found significant deficits in McCarrick’s memory during two interviews in June, and he was often unable to recall what they had discussed from one hour to the next. Dr. Kerry Nelligan said she administered a number of tests on two occasions in June. As with any form of dementia, she said there are no medications that could improve the symptoms.“It’s not just that he currently has these deficits,” Nelligan said. “There is no way they are going to get better.”Without being able to remember discussions, he could not participate with his lawyers in his defense, she said.McCarrick appeared via a video link during the hearing. He was not exempt from facing charges because the clock stopped on the statute of limitations when he left Massachusetts.Mitchell Garabedian, a well-known lawyer for clergy sexual abuse victims who is representing the man accusing McCarrick, said in June that his client was discouraged by the prosecution expert’s findings.“In spite of the criminal court’s decision today,” Garabedian said following Wednesday's hearing, “many clergy sexual abuse victims feel as though former Cardinal Theodore McCarrick is and will always be the permanent personification of evil within the Catholic Church.”The Associated Press generally does not identify people who report sexual assault unless they agree to be named publicly, which the victim in this case has not done.The accuser told authorities during a 2021 interview that McCarrick was close to the man’s family when he was growing up. The man said McCarrick also sexually assaulted him in a coat room after they returned to the reception.Prosecutors say McCarrick told the boy to say the “Hail Mary” and “Our Father” prayers before leaving the room.

Ex-Cardinal, who lived in Kansas, won't stand trial for sex abuse

RILEY COUNTY—Law enforcement authorities are investigating a high school student for an alleged school threat.

Just after 2p.m. Tuesday, police arrested 16-year-old&nbsp; Brycen Tyler, 16, of Manhattan at Manhattan High School&nbsp; after it was reported he made threats of violence and indications he may possess a weapon, according to the Riley County Police Department activity report.

A School Resource Officer made contact with Tyler after receiving reports of these comments and found that he was not in possession of a weapon.

“The Sacred Red Rock has long been part of Kansas’ history, and I am honored to participate in its return to its rightful stewards,”&nbsp;Governor Kelly said.&nbsp;“This event marks a significant step forward in ensuring we respect and honor Indigenous peoples, cultures, and traditions.”&nbsp;

Several hundred thousand years ago, a glacier took the rock from an area in what is now southwestern Minnesota to the Kansas River Valley, where it became an important part the Kaw Nation’s spiritual life.&nbsp;&nbsp;&nbsp;

“I am delighted to see our city’s leaders collectively honor the sovereign rights of Tribal Nations by partnering in the return of the Iⁿ‘zhúje‘waxóbe Sacred Red Rock,”&nbsp;said Jancita Warrington,&nbsp;Executive Director, Kansas Native American Affairs,&nbsp;Office of the Governor.&nbsp;“Chancellor Girod, Mayor Larsen and the Lawrence City Commissioners have shown both compassion and respect for the Kaw Nation by honoring their request to return this grandfather rock to its cultural and spiritual stewards.  Gov. celebrates return of sacred Red Rock to the Kaw Nation 

SEDGWICK COUNTY —A man arrested after a 16-hour standoff in Lawrence is now charged in the death of&nbsp;51-year-old Jose Lumbreras of Wichita.

Kevin Harris, 63 of Lawrence, is charged with 1st&nbsp;degree murder, according to the Sedgwick County District Attorney's office.

On Aug. 22, police in Wichita arrested&nbsp; 50-year-old Monicie Ramirez in connection with the crime. Police in Lawrence took&nbsp; Harris into following a prolonged standoff.

Just after 11 p.m. August 22, police learned Harris had fled Wichita and was believed to be inside an apartment in the 1400 block of Bristol Terrace in Lawrence, according to Police Sgt. Drew Fennelly 

 While working to gather more information from Wichita, officers in Lawrence set up a perimeter on the apartment building, and gathered information that led investigators to believe the suspect was present.

The Lawrence Police Crisis Response Team was activated and responded to the area, as well our Crisis Response Negotiators and&nbsp; the Unoccupied Aerial Vehicle team.

Crisis Negotiators were able to establish contact with people in the apartment and verified Harris was there. The Lawrence Police tactical team then began methodically evacuating the apartment building when it was clear the suspect was not going to come out, and was allegedly armed. 

After multiple hours of discussion, negotiators were able to convince Harris to allow a woman in the apartment to leave.&nbsp; Following multiple additional hours of discussion, negotiators convinced Harris to also leave the apartment and he peacefully surrendered at&nbsp;3:30 p.m., according to Fennelly.

&nbsp;Harris, of Lawrence, was turned over to investigators from the Wichita Police Department and is now being held on a $500,000 bond.

Kan. congressman wants Biden's email as vice president released

SEDGWICK COUNTY —A friend has established an online fundraiser to help the family of&nbsp; 19-year-old Zaiylah Bronson from Wichita who was the victim of domestic violence over the weekend.

Just after 11a.m. Saturday, 911 dispatch in Sedgwick County received a call from a 911 operator from North Carolina reporting a possible homicide in the Wichita area, according to Officer Juan Rebolledo.

Based on the information given to the North Carolina 911 operator by a family member of the suspect, Wichita police officers were sent to two different locations, the 3900 block of E 17th Street North in Wichita and the 7600 block of E 21st Street N in Wichita.

Upon arrival at the 21st Street address, officers contacted 22-year-old Alexander Lewis and located Bronson's body of in the trunk of his vehicle. Officers pulled her body out of the trunk and provided life-saving measures until EMS arrived on the scene.

She was later pronounced deceased by EMS. Police arrested Lewis on requested charges of second-degree murder. He is expected to make a first court appearance later this week.

SEDGWICK COUNTY —Voters rejected school bond issues across Kansas on Tuesday. The Sedgwick County Election Commissioner reported the $73,900,000 school bond issue in USD 262&nbsp; Valley Center did not pass.

The unofficial count reported&nbsp;2,159 voted against the bond and 1,983 district patrons voted in favor of the bond issue.

According to a statement on the Valley Center School district web site, "Those who live in the communities we serve have decided that now is not the time to move forward with additional classroom space and accommodations for every student."

"While the bond did not pass, the needs remain. Because several USD 262 schools are at or over capacity with students and our district continues to grow, classroom space will have to be addressed."

Oberlin USD 294 voters said no to a $29 million bond issue for significant upgrades at the elementary and high school 621-362, according to the county election office.

USD 214 Ulysses voters rejected a $44.75 million project to build a new middle school wing at Ulysses High School, transition it to a 7-12 grade campus. It also included new science labs and weight room; upgrades to all classrooms; and expanded shop areas, kitchen, and music rooms.

The project also addressed ADA and safety concerns and mechanical system upgrades district-wide. The elementary buildings will also see renovations to classrooms, hallways, improved security and student safety.&nbsp; The unofficial vote count&nbsp; 929-241.

Voters in USD 210 Hugoton overwhelmingly voted down&nbsp;a $36 million bond issue&nbsp;for safety improvements and classroom renovations 893-244.

Voters reject bond issues in 4 Kansas school districts

LOS ANGELES (AP) — U.S. officials said Tuesday that the FBI and its European partners infiltrated and seized control of a major global malware network used for more than 15 years to commit a gamut of online crimes including crippling ransomware attacks.

They then remotely removed the malicious software agent — known as Qakbot — from thousands of infected computers.

Cybersecurity experts said they were impressed by the deft dismantling of the network but cautioned that any setback to cybercrime would likely be temporary.

“Nearly ever sector of the economy has been victimized by Qakbot,” Martin Estrada, the U.S. attorney in Los Angeles, said Tuesday in&nbsp;<a href="https://www.justice.gov/usao-cdca/pr/qakbot-malware-disrupted-international-cyber-takedown">announcing the takedown.</a>&nbsp;He said the criminal network had facilitated about 40 ransomware attacks alone over 18 months that investigators said netted Qakbot administrators about $58 million.

Qakbot's ransomware victims included an Illinois-based engineering firm, financial services organizations in Alabama and Kansas, along with a Maryland defense manufacturer and a Southern California food distribution company, Estrada said.

Officials said $8.6 million in cybercurrency was seized or frozen but no arrests were announced.

Estrada said the investigation is ongoing. He would not say where administrators of the malware, which marshaled infected machines into a botnet of zombie computers, were located. Cybersecurity researchers say they are believed to be in Russia and/or other former Soviet states.

Officials estimated the so-called malware loader, a digital Swiss knife for cybercrooks also known as Pinkslipbot and Qbot, was leveraged to cause hundreds of millions of dollars in damage since first appearing in 2008 as an information-stealing bank trojan. They said millions of people in nearly every country in the world have been affected.

Typically delivered via phishing email infections,&nbsp;<a href="https://attack.mitre.org/versions/v11/software/S0650/">Qakbot gave criminal hackers</a>&nbsp;initial access to violated computers. They could then deploy additional payloads including ransomware, steal sensitive information or gather intelligence on victims to facilitate financial fraud and crimes such as tech support and romance scams.

The Qakbot network was “literally feeding the global cybercrime supply chain,” said Donald Alway, assistant director in charge of the FBI's Los Angeles office, calling it “one of the most devastating cybercriminal tools in history.” The&nbsp;<a href="https://blog.checkpoint.com/security/check-point-shares-analysis-of-qakbot-malware-group/">most commonly detected malware</a>&nbsp;in the first half of 2023, Qakbot impacted one in 10 corporate networks and accounted&nbsp;<a href="https://www.reliaquest.com/blog/the-3-malware-loaders-behind-80-of-incidents/">for about 30% of attacks globally,</a>&nbsp;a pair of cybersecurity firms found. Beginning Friday in an operation officials dubbed “Duck Hunt,” the FBI along with Europol and law enforcement and justice partners in France, the United Kingdom, Germany, the Netherlands, Romania and Latvia seized more than 50 Qakbot servers and identified more than 700,000 infected computers, more than 200,000 of them in the U.S. — effectively cutting off criminals from their quarry.

The FBI then used the seized Qakbot infrastructure to remotely dispatch updates that deleted the malware from thousands of infected computers. A senior FBI official, briefing reporters on condition he not be further identified, called that number “fluid” and cautioned that other malware may have remained on machines liberated from Qakbot.

It was the FBI's biggest success against cybercrooks since it&nbsp;<a href="https://apnews.com/article/technology-politics-health-crime-us-department-of-justice-ed17a8853d78a9d0185af04cb8bd2fd2">“hacked the hackers”</a>&nbsp;with the January takedown of the prolific Hive ransomware gang.

“It is an impressive takedown. Qakbot was the largest botnet" in number of victims, said Alex Holden, founder of Milwaukee-based Hold Security. But he said it may have been a casualty of its own success in its staggering growth over the past few years. “Large botnets today tend to implode as too many threat actors are mining this data for various types of abuse.”

Cybersecurity expert Chester Wisniewski at Sophos agreed that while there could be a temporary drop in ransomware attacks, the criminals can be expected to either revive infrastructure elsewhere or move to other botnets.
