Thomas Jefferson once wrote critically of those who “look at constitutions with sanctimonious reverence, and deem them like the arc of the covenant, too sacred to be touched.” While he firmly opposed “frequent and untried changes in laws,” he argued that, in the end “laws and institutions must go hand in hand with the progress of the human mind.” In other words, as people learn and grow and change, their constitutions necessarily should too.

These words are on my mind today, with one failed constitutional amendment in our recent past and another constitutional amendment facing Kansas voters this coming November.

There have always been Americans who believe that society needs clear and unchanging constitutional rules, reflecting clear and unchanging values, or else it will fall apart. It’s undeniable that there is much&nbsp;truth in that belief.

But some of these people seem to express far more confidence as to the content of those values, and the operation of those rules, than is justified. Which means that when the democratically expressed interests of the people — their “mind” in Jefferson’s terms — come to challenge what those individuals assume to be necessarily unchanging rules and values, they sometimes see it as a political development that they need to save the “true” or “authentic” constitution from.

When the Kansas Supreme Court determined that the guarantee of “equal and inalienable natural rights” in the Kansas Constitution included at least a limited protection of “bodily integrity” and therefore the right of Kansas women to choose abortion, anti-abortion voters, and those who represent them, were furious, which was to be expected. But their response was to propose amending the Kansas Constitution itself, so as to make it impossible for people to legally or politically interpret the document in that way. That proposal was firmly rejected on August 2.

Come November 8, there will be another amendment on the ballot, this one designed to increase the power of the legislature in Topeka, enabling it to exercise exclusive veto power over how the governor chooses to implement the laws which the legislature itself had written and passed. This proposal, like the last one, is driven by political fury, this time to the way Governor Kelly, at the beginning of the pandemic, used the power granted her under existing laws to order school closures and take other extensive public health measures, actions that were highly unpopular with certain voters and their representatives. A legislative veto is their proposed response.

Legislative vetoes aren’t a new idea; there are plenty of good legal and theoretical arguments both for and against them. What’s notable here is not the arguments being made, but the political reality inspiring them. In both cases, we have a specific action or decision which created a conviction that something shouldn’t be politically possible—that abortion can’t possibly be interpreted as a right, or that a governor’s emergency powers can’t possibly be used in ways which a legislative majority dislikes—in turn causing people who claim to value stability looking to change the constitutional basis of those powers and interpretations themselves.

I’m with Jefferson; I don’t think constitutions are sacred, and changing them doesn’t strike me as at all illegitimate. But when the impetus behind a proposed amendment isn’t an engagement with legal or theoretical arguments, but rather a politically-driven conviction, maybe voters should think twice. They did three weeks ago; whether they will again in November remains to be seen.

A recent article published by the Kansas Reflector on August 12, 2022, and reprinted in multiple newspapers, detailed the Federal forfeiture and civil lawsuit involving Saint Francis Ministries and a few of its former leaders. The article contained inaccurate statements about Saint Francis Ministries, which could have been avoided had the news outlet taken the time to contact us for comment.

The article suggests that millions of dollars were not properly accounted for; these statements are false. The comments in the article lead the reader to an inaccurate understanding of the situation. Over the past twenty-two months, the Saint Francis Ministries team has cooperated with investigators, auditors, and state partners to ensure accurate accounting and complete transparency. In summary, there are no unaccounted dollars as we continue to openly assist and support government organizations with their inquiries.

The article also claims that Nebraska severed ties with Saint Francis over performance concerns. This is also inaccurate. Both parties agreed to mutually terminate the contract. Nebraska ended privatization in the state, and did not replace Saint Francis with another contractor. Nebraska and Saint Francis continue a strong working relationship in providing services for Nebraska children and families.

Thankfully, Saint Francis Ministries is financially sound. Our fiscal operations are healthy and our systems are strong. This outcome is due to hard work, sacrifice, and dedication of the entire Saint Francis Ministries team.

The Kansas Department of Health and Environment (KDHE) and the Kansas Department of Wildlife and Parks (KDWP) have issued several public health advisories for Kansas lakes due to blue-green algae.&nbsp;

Public health advisories for Kansas lakes due to blue-green algae

The Kansas Corporation Commission (KCC) has been awarded a $25 million initial federal grant to help plug abandoned wells in the state. The initial grant is part of $1.15 billion earmarked under the Federal Infrastructure Investment and Jobs Act to help states remediate abandoned oil and gas wells. A total of $4.7 billion has been allocated over the next eight years to plug abandoned wells in the U.S. The KCC is eligible to receive another $33.6 million in future formula grant funding.

“These federal grants provide Kansas with a one-time opportunity to help address the issue of abandoned wells in Kansas while helping the economy by providing good paying jobs for several years,” said Ryan A. Hoffman, KCC Conservation Division Director.

The KCC plans to use the initial $25 million grant to pay for eight projects involving the plugging of more than 2300 abandoned wells over the next two to three years.&nbsp; Four projects are located in Eastern Kansas. The other four are located in Central and Western Kansas. A well is considered “abandoned” when it has been permanently taken out of production, is not properly plugged to prevent possible air or groundwater pollution, and the rightful legal owner cannot be determined or located to take responsibility.

While the federal grants will help reduce the total number of abandoned wells in Kansas, they are insufficient to address the entire problem.&nbsp; The KCC will still rely on industry generated funds to plug the thousands of wells remaining after the federal program expires.

More than 11,000 abandoned wells have been plugged since the establishment of the state well plugging fund in 1995. Oil and gas drilling in Kansas began in the 1860’s. Record keeping by early operators was not as precise as it is today. It is not uncommon for older abandoned wells to be discovered by landowners who were unaware they existed.

&nbsp;“These federal grant funds will provide important assistance in plugging abandoned wells in Kansas. However, to adequately protect Kansas fresh water resources, it will also be necessary to continue funding the plugging of abandoned wells with state well plugging fund resources provided by oil and gas industry fee assessments,” said Dwight D. Keen, Chair of the KCC.

A total of $4.7 billion has been allocated over the next eight years to plug abandoned wells in the U.S. The KCC is eligible to receive another $33.6 million in future formula grant funding.“These federal grants provide Kansas with a one-time opportunity to help address the issue of abandoned wells in Kansas while helping the economy by providing good paying jobs for several years,” said Ryan A. Hoffman, KCC Conservation Division Director.The KCC plans to use the initial $25 million grant to pay for eight projects involving the plugging of more than 2300 abandoned wells over the next two to three years.&nbsp; Four projects are located in Eastern Kansas. The other four are located in Central and Western Kansas. Oil and gas drilling in Kansas began in the 1860’s. Record keeping by early operators was not as precise as it is today. It is not uncommon for older abandoned wells to be discovered by landowners who were unaware they existed.&nbsp;“These federal grant funds will provide important assistance in plugging abandoned wells in Kansas. However, to adequately protect Kansas fresh water resources, it will also be necessary to continue funding the plugging of abandoned wells with state well plugging fund resources provided by oil and gas industry fee assessments,” said Dwight D. Keen, Chair of the KCC.

The City of Great Bend will conduct a ground breaking ceremony for the construction of the new police station on Sept. 12 at 11:30 a.m. at the 12th Street and Baker Avenue intersection.&nbsp; 

Construction on the 20,100 square-foot building is scheduled to be finished by next August. The total expense to construct and completely furnish the police station will cost $8,883,273.

A .10% sales tax increase approved by voters last November will go towards bond debt for the police station with a 20-year sunset. Through the sales tax revenue and savings, the city exceeded the budget by $902,667. Through SPARKS funds, insurance proceeds and ARPA interest, the city will make up the difference.

Ground breaking ceremony for new Great Bend police station Sept. 12

Let’s visit a birthplace – not of a president or a general, but the birthplace of a cattle breed. Today we’ll learn more about an innovative family that helped develop a new breed of cattle in rural Kansas.&nbsp;

<a href="https://www.ksre.k-state.edu/news/stories/2022/08/kansas-profile-hoagland-jn-ranch.html">Last week in this column</a>, we met Dirck and Natalie Hoagland of J&amp;N Ranch near Leavenworth. Dirck’s parents, Joe and Nancy Hoagland, bought the place near Leavenworth in 1985 and have expanded operations since. For years, they raised registered Hereford cattle.&nbsp;

Hereford cattle are recognized for having a white-colored face and a red-colored body.&nbsp;&nbsp;During the 1990s, the Hoaglands and their friend John Gage had the idea of trying to breed Herefords that had the traditional white face but were black in color.&nbsp;

To traditional cattle producers, the name black Hereford might sound like an oxymoron – a contradiction in terms, like jumbo shrimp or single option. Yet these breeders wanted the carcass quality and market premiums of black Angus, while retaining the hardiness, docility and versatility of the Hereford breed.&nbsp;

They did so using the same process as that used by other breeds; namely, by introducing Angus genetics and then selecting for black hair color in the descendent generations.&nbsp;

When Joe Hoagland’s friend, John Gage, passed away from cancer, Joe purchased cattle and records from his estate and established the Black Hereford Registry in the barn office at the J&amp;N Ranch in 1999. Joe and Norma registered the first black Hereford and purchased the first membership in the American Black Hereford Association.&nbsp;

Later, the Hoaglands publish the first Black Hereford magazine and hold the first ABHA national sale.&nbsp;

As the association grew, the breed headquarters moved from J&amp;N Ranch to a Kansas City office in 2011. In 2017, Joe and Norma were inducted into the American Black Hereford Association Hall of Fame. Today the association has 500 breeders in 45 states plus overseas. All of these trace their cattle lineage back to the J&amp;N Ranch in Kansas.&nbsp;

Joe and Norma’s son, Dirck, and his wife, Natalie, now operate J&amp;N Ranch, which continues to be a major producer of black Hereford cattle.&nbsp;&nbsp;Bull and heifer development takes place at the ranch near Leavenworth. Their summer pasture is in Wabaunsee County at the Hoagland’s Gun Barrel Ranch, located near the rural community of Eskridge, population 439 people. Now, that’s rural.&nbsp;

The Hoaglands recently received a Kansas Wildlife Habitat Conservation award from the Kansas Department of Wildlife and Parks for their work to improve prairie chicken habitat on the Wabaunsee County ranch. In this case, improving habitat meant removing trees so as to reduce predator risk for the prairie chicken.&nbsp;&nbsp;“We believe that we should protect the original species on the prairie,” Dirck said.&nbsp;

J&amp;N Ranch has two production sales yearly, selling bulls and females. Their breeding stock is sold across the Midwest and beyond. They’ve sent bulls as far east as Pennsylvania and as far west as Hawaii.&nbsp;

“One of our favorite things is delivering bulls and seeing our customer’s operations first hand,” Dirck Hoagland said (although the bulls that went to Hawaii were shipped by plane, so it sounds like the Hoaglands missed out on that trip).&nbsp;&nbsp;“It’s great to travel around and see how our genetics have benefitted our customers’ herds.”&nbsp;

Dirck and Natalie have two boys, Dayton and Reed, ages 10 and 8. The Hoaglands value their rural, agricultural lifestyle deeply and seek to pass it on. “Natalie and I were very lucky to be able to come back into our family operation,” Hoagland said.&nbsp;

“Our one driving goal is to give these two boys the opportunity to live this life on the ranch if they choose to do so,” he said. “We want to be able to provide this opportunity to the next generation.”&nbsp;

Now That’s Rural: Dirck Hoagland, Black Herefords

Now the folks at Heartland Farm, 13 miles west of Great Bend, will know exactly "hoo" is talking during video conferences. A $750 grant awarded by the Golden Belt Community Foundation paid for most of a new Owl Labs 360-degree conference camera the farm can now use to simplify virtual meetings.

"Since COVID happened, we are doing more and more programs virtually," said Heartland Farm Marketing and Media Coordinator Teresa Johnson. "Sometimes it's hard when you have a group of people, they're all on Zoom, and nobody knows who's talking. We will use it for programs, and of course, we'll use it for virtual meetings for the staff and advisory council."

The Owl camera - which even looks like an owl - is an all-in-one device with a camera, microphone, and speakers. Even more, the camera pivots to find the speaker in the room, zooming and focusing on the speaker for clarity in online meetings.

"It still will show the other people at the top of the screen, but it's more interactive," Johnson said. "Instead of us sitting as a group and no one knows who is speaking, it will turn and focus on the speaker automatically."

The Owl Labs camera retails for approximately $1,000. Heartland Farm was one of eight organizations to receive a Golden Belt Spring Community Building Grant from the Golden Belt Community Foundation. This round of grants totaled just over $15,000.

A $750 grant awarded by the Golden Belt Community Foundation paid for most of a new Owl Labs 360-degree conference camera the farm can now use to simplify virtual meetings."Since COVID happened, we are doing more and more programs virtually," said Heartland Farm Marketing and Media Coordinator Teresa Johnson. "Sometimes it's hard when you have a group of people, they're all on Zoom, and nobody knows who's talking. We will use it for programs, and of course, we'll use it for virtual meetings for the staff and advisory council."The Owl camera - which even looks like an owl - is an all-in-one device with a camera, microphone, and speakers. Even more, the camera pivots to find the speaker in the room, zooming and focusing on the speaker for clarity in online meetings."It still will show the other people at the top of the screen, but it's more interactive," Johnson said. "Instead of us sitting as a group and no one knows who is speaking, it will turn and focus on the speaker automatically."The Owl Labs camera retails for approximately $1,000. Heartland Farm was one of eight organizations to receive a Golden Belt Spring Community Building Grant from the Golden Belt Community Foundation. This round of grants totaled just over $15,000.

Heartland Farm receives grant for new teleconference technology

Thousands of vehicles will travel the Kansas roadways during the Labor Day weekend. Many families will head out on one last trip or getaway as the school year begins. Safe Kids Kansas, sponsored in part by the Kansas Department of Health and Environment, State Farm and the Kansas Department of Transportation (KDOT), want to encourage families to buckle up and drive safely to protect their most valuable asset, their families.

This year, from August 27 through September 11, a safety belt awareness campaign called “Bucks for Buckles” is being held in 45 cities across Kansas. Local volunteers distribute dollars bills to drivers who have all occupants buckled up securely in their vehicle. Those riding unrestrained will receive educational materials about the effectiveness of seat belts and child safety seats in saving lives and reducing injuries.

“No one can predict when they will be involved in a motor vehicle crash, yet almost all of us will be involved in an automobile crash in our lifetime. In 2020, 426 people lost their lives on Kansas roadways, and 52 percent&nbsp; were unbuckled,” said Cherie Sage, State Director for Safe Kids Kansas. “The single most effective means of protecting the lives of you and your passengers is wearing seat belts and using appropriate child restraints every time you ride in the vehicle – even short distances.”

According to the 2021 KDOT Seat Belt Survey, 85 percent of Kansans surveyed were wearing their seat belts. This compares to the national average is 90 percent.&nbsp;Kansas ranked 38 in belt use in 2021 among 50 states and the District of Columbia. Seat belts save more than 15,000 lives yearly and are the best defense against drunk, aggressive and distracted drivers.

&nbsp;“Seat belts are the single most effective device you can use to save your life during a vehicle crash,” said Sage. “They also reduce your chances of having a serious injury by as much as 50 percent. It’s such a simple thing, so take your life into your own hands and buckle up.”

Money rewarded to Kansas drivers who buckle up

Cats and dogs are always adorable. Maybe a little more so when they are free and need a home. This Saturday, Golden Belt Humane Society will be one of many shelters around the nation hosting "Clear the Shelter" events. Adoption fees for animals will be waived at the event from 10 a.m. to 3 p.m. Golden Belt Humane Society Director Heather Acheson explains how.

"Clear the Shelter is a nationwide event that helps promote pet adoptions from shelters that may be overcrowded and overflowing," she said. "We have sponsors that send us donations to cover those adoption fees. We also do some fundraising to help cover some of those adoption fees. For us at the Golden Belt Humane Society, we require you to have an approved application on the big day."

As of Thursday afternoon, the shelter had 28 cats, 17 dogs, three rabbits, and two hamsters up for adoption. Acheson reminds the public they can keep numbers down by spaying and neutering pets and by being responsible pet owners.

"It's cheaper to fix your fence than it is to receive citations or impound fees here at the shelter," she said. "Spay and neuter is our biggest thing. Currently, we have four litters of puppies. One is going to be part of our Clear the Shelter, but three are not ready - they're too young. Anyone is invited to come out during the week when it's not an event, maybe to volunteer and walk a day in our shoes to see what we go through and what we work with as far as numbers go."

Golden Belt Humane Society staff will be joined by KSN and the Kansas Humane Society for Saturday's Clear the Shelter.

Claflin & Larned KDOT employees celebrate service anniversaries

Padding the salaries makes a big difference when trying to fill open
vacancies, just ask Barton Community College. 

In June, the college in Great
Bend reported 65 job openings, and some of those positions were open for over
three years. In July, the Barton Board of Trustees voted to give all regular
staff an 8% pay increase and make sure all open positions offer market value
income. The number of regular positions open, as of Wednesday, was 18. 
Barton Vice President of Administration Mark Dean knew the college was in
position to fix the staffing shortage with more than $19 million in cash
reserves. 
"The pay increase made a huge difference," said Dean. "We had some positions that were vacant for a couple of years that we had no applications for. A couple weeks after the approved increase, we had two or three applications for those positions." 
Just before the school year started last fall, all regular staff at Barton
Community College received a 7% pay increase. Barton President Dr. Carl Heilman
commended staff for working to fill many vacancies. 
"I'm very grateful to the hard work of many managers and those supporting position vacancies during the search process," said Heilman. "They were able to find capable individuals and are able to fill our vacancies."

Hunting season is just around the corner, and the sport is a tradition for many around the state. A relatively new organization in Kansas is looking to carry on the tradition. Pass it On Outdoor Mentors, a 501(c)(3) non-profit organization, started in Wichita in 2002. Now expanding, Pass it On is hosting several outdoors activities around the state, including a dove hunt near Great Bend on Sept. 1

"It goes beyond just hunting and fishing," said Pass it On's Western Kansas Coordinator Bobby Cole. "You're going to learn life skills while you're out there hunting. There's patience involved, there's persistence involved, there's hard work. As for the hunting side of things, if we don't have hunters, we don't have conservation as we know it in the U.S. We have to teach these kids to do this so they can carry on the wildlife we have in the U.S."

The Great Bend hunt is limited to four hunters between the ages of 11-18. All youth attending must have a parent or trusted adult present, and all must have passed a hunter safety course and possess valid hunting licensing. The group will meet at Kansas Trophy Experience Lodge just south of the Great Bend city limits on U.S. 281 Highway, then travel to a private hunting ground. The youth will hunt until they reach the dove limit or get tired.

"Dove hunting, usually you'll go out and post in a field you know the dove are probably feeding in," Cole said. "You'll put up some decoys and the dove will come right in. As they come in, you can harvest them."

A big water project is in the works for northern Barton and southern Russell counties. Mary Anne Stoskopf, secretary and treasurer for Barton County Rural Water District No. 1, and Jamie Tomlinson, manager for Russell County Rural Water District No. 3, asked the Barton County Commission for assistance funding the project at Wednesday's meeting. The commission agreed to meet the districts halfway by allocating $65,000 toward the project.

"Fifty years ago a small group of neighbors north of Hoisington recognized a need and invested in a rural water district for the future," Stoskopf told the commission. "Fifty percent of the homes that water district serves today are descendants of those - they are owned and occupied by descendants of those original investors. Another 25 percent are second owners - they bought their home from an original investor."

A lengthy discussion ensued about grant availability, how many residents would be affected, and whether or not the project should be considered maintenance of an existing system or construction of a new one.

"No, we're not asking for maintenance because without the improved infrastructure, the volume of water we're taking and connecting with Hoisington will not sustain with the system that's currently there," Tomlinson argued.

Stoskopf and Tomlinson were asking for $135,000 from the commission for the installation of an 8-mile stretch of large water main that would connect city of Hoisington water to the districts. Once the project is complete, Russell County Rural Water District 3 will absorb Barton County Rural Water District 1.

While Barton's current district serves just eight residences, Stoskopf said the new project will impact nearly 800 Barton County residents residing in Odin, Beaver, Susank, Galatia, and several rural townships.&nbsp;

Barton County Sheriff's Booking Activity 8/25

In 1951, the Boy Scouts Troop 147 in La Crosse was instrumental in the
construction of a smaller replica of the Statue of Liberty in New York. 
As part of the Boy Scouts of America’s 40th anniversary in 1950, a
campaign started to position the statue replicas across the United States.
Approximately 200 Statue of Liberty replicas were installed in the country as
part of the “Strengthen the Arm of Liberty” campaign, with 26 of them located
in Kansas. 
Mike Pivonka was a member of the Boy Scouts troop in La Crosse in the 1950s
that helped raise the money for the statue located in City Park, along Main
Street. 
"The scout troop here collected newspapers, cardboard, any kind of paper products that we could ship to Hutchinson and get a little money for," said Pivonka. "We used an empty garage to tie these things all up until we had a truckload. The American Legion and VFW kicked in some money. Finally, it accumulated enough money to get the statue bought." 
Statues were sold for $300 - $350 in the 1950s. 
The roughly 8' tall statue rests on a large stone base. The base was in
bad shape and starting to fall apart. La Crosse City Manager Duane Moeder asked
Pivonka this year about repairing the base. 
"We were able to find a brick layer that would work on it, but then we couldn't find any brick that matched the original," said Pivonka. "Duane found some material very similar to the buildings in the park. They were made out of post rock limestone." 
A brick layer then duplicated what was originally constructed, a seven-point
star base, a replica of the statue in New York. 
Before placing the statue back, Pivonka took the creation to his shop at Flame
Engineering in La Crosse where he soldered cracks and holes.

"There were over 30 places in the statue that needed repair," said Pivonka. "I'm an old farm boy and learned how to solder many years ago from my dad. It was pretty slow going. You had to be careful not to destroy any of the features originally there."

Pivonka said there was close to $16,000 raised for the renovation of the
statue. Community members and scouts from the original Troop 147 contributed to
the project. 

"I started searching out old scouts that were in that troop," said Pivonka. "It took some time to reach all of them. They were all very gracious and helped us out considerably."

The Golden Belt Community Foundation also awarded the City of La
Crosse a $2,000 grant for the repairs. Pivonka and city officials are still raising
funds to pay for the restoration.&nbsp; &nbsp; &nbsp;
